HomeMy WebLinkAbout11938 ORD - 03/06/1974JRR:jkh:hb:3 /4174:lst • AN ORDINANCE APPROPRIATING THE SUM OF $10,212.40 OUT OF NO. 291 PARR BOND FUND, APPLICABLE TO PROJECT N0. 291 -70 -8, FOR ADDITIONAL COMPENSATION FOR ACQUISITION OF PARCELS 25A AND 25B, BAYFRONT OPEN SPACE PARR PROJECT, OWNED BY E. N. FULGHUM AND PAUL EAMON, RESPECTIVELY, AND FOR APPRAISAL EXPENSES, DEPO- SITION COSTS AND OTHER INCIDENTAL EXPENSE IN CONNECTION WITH SAID ACQUISITIONS, BEING MATTERS IN CONDEMNATION IN THE COUNTY COURT AT LAW NO.2 OF NUECES COUNTY, TEXAS; AND DECLARING AN EMER- GENCY. WHEREAS, the City of Corpus Christi and the owners of Parcels 25A and 25B, Bayfront Open Space Park Project, have heretofore been unable to agree on the value of the said parcels, and authorization was given to acquire said parcels through eminent domain proceedings; and WHEREAS, Condemnation Cause No. 659, styled City of Corpus Christi vs. E. N. Fulghum, et al, involving Parcel No. 25A, was set for trial and heard before Special Commissioners on July 10, 1972, and Con- demnation Cause-No. 654, styled City of Corpus Christi vs. Paul Hamon, et al, involving Parcel No. 25B, was set for trial and heard before Special Commissioners on September 15, 1972, and after making preliminary motions and arguments it was deemed in the best interest of the City to effect settlement; and WHEREAS, a value of the properties was agreed upon between the owners and the City, and based on the agreement, further trial of the cases was withdrawn: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated out of the No.291 Park Bond Fund the sum of $10,212.40, applicable to Project No. 291 -70 -5, Bayfront Open Space Park Site, for additional compensation for acquisition of Parcels 25A and 25B, owned by E. N. Fulghum and Paul Hamon, respectively, and for appraisal expenses, deposition costs and other incidental expenses in connection with said acquisition, being matters in condemnation in the County Court at Law No. 2 of Nueces County, Texas. 11938 �J SECTION 2. The necessity to immediately appropriate the sums described above for the purposes set forth in order that the City may take possession of the aforesaid parcels and proceed with the Sayfront Open Space Park Project without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at' three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED , this they of March, 1974.
