HomeMy WebLinkAbout11943 ORD - 03/06/1974JRR:RWC:Jkh ;3 -6 -74; 1st s AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 7A, SECTIONS 7A -1 & 7A -2; DELETING SUBSECTION ZA-2,02 AM ,ADOPTING SECTION 7A -3: D TFTTN( SUBSECTION 7A7--2.01 AND ADOPTING SECTION 7A -4; ALL OF THE AFORESAID AMENDMENTS BEING FOR THE PURPOSE OF SEPARATING THE DIFFERENT MOBILE HOME pEnLopKENTS NOW r RMTTTFn UNDER THE "T -1" MOBILE HOME DISTRICT REGULATIONS AS SET FORTH IN ARTICLE 7A AND ESTABLISHING A_ "T -lA" TRAVEL TRAILER PARK DISTRICT A "T -1B" MOBILE HOME PARK DISTRICT AND A "T-IC"-MBILE HOME SUBDIVISION DISTRICT. AND CHANGING THE TEXT SO AS TO ESTABLISH THREE DISTINCT DISTRICTS SO ONE OR ALL CATEGORIES COULD BE APPLIED FOR AT THE TIME OF THE REQUEST PROVIDED THE APPLICANT HAS THE REQUIRED AMOUNT OF ACREAGE WITHIN EACH DISTRICT REQUESTED; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in, accordance with proper notice to the public, said public hearing having been held on March 6, 1974 at Regular Council Meeting of the City Council in the Council Chambers at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amend- ment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, at seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 11943 SECTION 2. That Article 7A of the Zoning Ordinance, entitled "T -1" Travel Trailer Park, Mobile Home Park, and Mobile Home Subdivision District Regulations ", be amended as follows: A. Amend Article 7A to hereafter read as follows: "'T-IA' Travel Trailer Park District Regulations, 'T -1B' Mobile Home Park District Regulations, and 'T -1C' Mobile Home Subdivision District Regulations." B. Amend Section 7A -1 to hereafter read as follows: "Section 7A -1. The regulations set forth in this article, or set forth elsewhere in this ordinance when referred to in this article, are the regulations of the 'T -lA' Travel Trailer Park District, 'T -1B' Mobile Home Park District and 'T -1C' Mobile Home Subdivision District. These dis- tricts are intended to preserve appropriate land for the development of single - family residences utilizing mobile home parks and subdivisions and also for the development of tourist accommodations which utilize travel trailer parks. It shall be unlawful for any person to construct, alter or extend any travel trailer park, mobile home park or mobile home subdivision area within the limits of the City of Corpus Christi unless he holds a valid building permit issued by the City Building Official in the name of such person for the specific construction, alteration, or extension proposed. Also all plans for specific construction, alteration, or extension of a travel trailer park, mobile home park, or mobile home subdivision shall have been submitted, reviewed and approved by the Department of Inspections and Operations according to the procedures established by the Platting Ordinance and all other applicable ordinances of the City of Corpus Christi before a permit is issued by the Building Official." C. Amend Section 7A -2 by deleting the subheading entitled "7A -2.01 Travel trailer parks ", and amending the heading of said Section 7A -2 to hereafter read as follows: "Section 7A -2 Use Regulations of the 'T -lA' Travel Trailer Park District." Add the following sentence after the heading and before the enumerated paragraphs (a) through (n): "An area or premises shall be used and developed according to the following regulations:" dA D. Delete Subsection 7A -2.02 and create Section 7A -3, the heading and the sentence preceding the enumerated paragraphs (a) through (k) pertaining to the development of Mobile Home Parks to hereafter read as follows: "Section 7A -3 Use Regulations of the 'T -1B' Mobile Home Park An area or premises shall be used and developed according to the following regulations:" E. Delete Subsection 7A -2.03 and create Section 7A -4, the heading and the sentence preceding the enumerated paragraphs (a) through (g) pertaining to the Mobile Home Subdivisions to hereafter read as follows: "Section 7A -4 Use Regulations for 'T -1C' Mobile Home Subdivision District. An area or premises shall be used and developed according to the following regulations:" SECTION 3. That all ordinances or parts of ordinances in direct conflict herewith are hereby expressly repealed. All other portions and parts of said Zoning Ordinance, as amended, are hereby kept in full force and effect. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. That the necessity of making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from -3- • Corpus Christi, Texas • day of , 19Z4 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
