HomeMy WebLinkAbout11944 ORD - 03/13/1974• ..RR:jkh:hb:2 /27/74:1st • AN ORDINANCE AMENDING ORDINANCE NO. 9472, PASSED AND APPROVED ON AUGUST 27, 1969, AS AMENDED, SO AS TO PROVIDE AN UNTREATED WATER RATE OF SIB CENTS (6 ¢) PER THOUSAND GALLONS PER MONTH FOR ALL WATER CONSUMED AND TO CHANGE THE MINIMUM CHARGES OF INDUSTRIAL AND MUNICIPAL CUSTOMERS AND TO ADD A COMMERCIAL MONTHLY CHARGE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERANCE CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, it has been determined that the cost of supplying raw water is at least six cents (6i) per thousand gallons: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 9472, passed and approved by the City Council on August 27, 1969, as amended, be and the same is here- by amended so as to provide an untreated water rate of six cents (60 per one thousand (1000) gallons for all water consumed and to provide a minimum monthly charge for industrial and municipal customers and to add a minimum commercial charge, said rates to hereafter provide as follows: UNTREATED WATER - INDUSTRIAL, MUNICIPAL, COMMERCIAL AND DOMESTIC All untreated water sold and delivered at the Calallen Pool, Lake Corpus Christi, or any other point of delivery where such water is available directly to the consumer shall be at the following rates: Rates Charge For all untreated water consumed $.06 per 1000 gallons Minimum Charge Minimum Monthly Charge, Industrial and Municipal Minimum charge to equal to the average of the highest previous three calendar years, or the previous calendar year's con- sumption, whichever is higher, divided by 116 MGD (2010 yield of reservoir) times 365 times 110% times $1,182,266 (the 1970 -86 average annual debt service for Lake Corpus Christi): Average of highest previous three calendar years, or the previous calendar year's, consumption, whichever is higher x 110% x $1,182,266 116,000,000 gallons per day x 365 Minimum Monthly Charge, Commercial To be determined by Superintendent of Water Division based on the meter size and whether the user is inside or outside the City limits. 11944 • Minimum Monthly Charge, Domestic $3.00 Minimum Annual Charge, Domestic $24.00 The City shall not be liable for failure to supply any particular quantity of water sought by any consumer. SECTION 2. That all ordinances or parts of ordinances in conflict herewith shall be and they are hereby repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made one time is the official publication of the city of Corpus Christi, which publication shall con- tain the caption stating in substance the purpose of the ordinance.
