HomeMy WebLinkAbout11949 ORD - 03/13/1974JRR:jkh:3- 12 -74; 1st AN ORDINANCE AMENDING ORDINANCE NO. 11927, PASSED AND APPROVED BY THE CITY COUNCIL ON FEBRUARY 27, 1974, BY AMENDING SECTION 6 THEREOF SO AS TO PROVIDE THAT THE PUBLIC HEARING PROVIDED IN SAID ORDINANCE NO. 11927, RELATIVE TO IMPROVEMENTS TO NUECES BAY BOULEVARD, FROM INTERSTATE 37 TO LEOPARD STREET, BE HELD APRIL 10, 1974, IN THE COUNCIL CHAMBER AT CITY HALL AT 3:00 P.M., IN LIEU OF MARCH 27, 1974; REPEALING ALL ORDINANCES IN CONFLICT HEREITITH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That Ordinance No. 11927, passed and approved by the City Council on February 27, 1974, be and the same is hereby amended by amending Section 6 thereof so as to provide that the public hearing relative to improvements to Nueces Bay Boulevard, from Interstate Highway 37 to Leopard Steet, be held April 10, 1974, in the Council Chamber at City Hall: at 3:00 P.M., in lieu of March 27, 1974, as presently provided in said Ordinance No. 11927. SECTION 2. That except as hereinabove provided, Ordinance No. 11927 shall be and remain in full force and effect. SECTION 3. That all ordinances or parts of ordinances in conflict herewith be and they are hereby expressly repealed to the extent of such conflict. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time by publishing in the official newspaper of the City of Corpus Christi the caption of this ordinance stating in substance the purpose of the aforesaid ordinance. 11949 SECTION 6. The necessity to make the change as hereinabove provided in order to comply with the requirements of Article 1105b of the State Statutes relative to publication of public notice concerning street improvements creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /3U day of March, 1974.
