AN ORDINANCE
AMENDING ORDINANCE NO. 11793, DATED NOVEMBER 14,
1973, ENTITLED "AMENDING THE ZONING ORDINANCE OF
THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN
VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND
RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME
AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106,
AS AMENDED, UPON APPLICATION OF _TACK L. AIMRUS, TRUS-
SES BY AMENDING THE ZONING MAP BY CHANGING THE ZONING
ON TEN ACRES OUT OF FARM LOT 2, SECTION 4, BOHEMIAN
COLONY LANDS MORE FULLY DESCRIBED HEREINAFTER,
SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, FROM 'R -1B" ONE- FAMILY DWELLING
DISTRICT TO 'B -4' GENERAL BUSINESS DISTRICT;
KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE
EXISTING ORDINANCE AS AMENDED; REPEALING ALL OR-
DINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY" SO AS TO CORRECT THE DESCRIPTION OF THE
TRACT OR PARCEL PROPOSED TO BE REZONED; KEEPING IN
EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE
AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE-
WITH; AND DECLARING AN EMERGENCY.
WHEREAS, the City Council on November 14, 1973, following a
public hearYng, approved change of zoning on a tract or parcel of land
described as ten acres out of Farm Lot 2, Section 4, Bohemian Colony Lands,
and accordingly passed Ordinance No. 11793 to evidence said approval; and
WHEREAS, it has been called to the attention of the City
Council that an erroneous description had been furnished by the Applicant
and it is deemed expedient that the description be corrected at the
earliest practicable date:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 11793, dated November 14, 1973,
entitled "Amending the Zoning Ordinance of the City of Corpus Christi
Adopted on the 27th day of August, 1937, appearing of record in Volume 9,
pages 565, et seq, of the Ordinance and Resolution Records, as amended
from time to time and particularly as amended by Ordinance no. 6106,
as amended, upon application of Jack L. Andrus, Trustee by amending the
zoning map by changing the zoning on ten acres out of farm lot 2, Section 4,
Bohemian Colony lands more fully described hereinafter situated in the City
of Corpus Christi, Nueces County, Texas, from 'R -1B' one - family dwelling

district to 'B -4' general business district; keeping in effect all other
provisions of the existing ordinance as amended; repealing all ordinances
in conflict herewith; and declaring an emergency" be and the same is hereby
amended by amending the description in Section 2 to hereafter read as follows:
Being 10 -acres of land out of Lot 20 Section 4,
Bohemian Colony Lands, a Subdivision in the City
of Corpus Christi, Nueces County, Texas, as shown
by map or plat thereof recorded in Volume A, page
48, Map Records, Nueces County, Texas, to which
reference is here made for a more particular
description, and being more fully described by
metes and bounds as follows, to -wit:
Beginning at a Texas State Highway Department Right -
of-Way Marker in the southeast line of Lot 7, and
the northwest line of Lot 20 Section 4, Bohemian
Colony Lands; said point being in the southwest
right -of -way line of State Highway 358 called South
Padre Island Drive.
Thence with the right -of -way line of State Highway
No. 358 S 61° 54' 09" E, a distance of 316.22
feet, to a right -of -way marker; S 57° 30' 48 "E, a
distance of 69.32 feet to an iron pipe;
'Thence S 28° 33' 55" W, 1125.85 feet to an iron
pipe for corner;
Thence N 61° 43' 05" W, 385.38 feet to the north-
west line of said Lot 2, to an iron pipe for
corner;
Thence N 28° 34' 15" E. a distance of 1130.05 feet
to the place of beginning and containing 10.00 acres
of land.
SECTION 2. Except as herein provided, the terms, conditions
and provisions of Ordinance No. 11793 shall be and remain in full force
and effect.
SECTION 3. That all ordinances or parts of ordinances in
conflict herewith are hereby expressly repealed to the extent of such
conflict.
SECTION 4. That the necessity of immediately making the
aforesaid change to correct the description of a tract or parcel proposed
for zoning in order to maintain at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of

its introduction and that such ordinance or resolution shall be read
at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, and having requested
the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full
force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED ,

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
