HomeMy WebLinkAbout11952 ORD - 03/13/1974JRR:jkh:hb:3 /12/74:lst • AN ORDINANCE APPROPRIATING THE SUM OF $9,527 OUT OF NO. 291 PARK BOND FUND, APPLICABLE TO PROJECT NO. 291 -70-8, FOR ADDITIONAL COMPENSATION FOR ACQUISITION OF PAR- CEL 26, BAYFRONT OPEN SPACE PARK SITE 03, OWNED BY EDITH SEEGER, BEING A MATTER IN CONDEMNATION IN THE COUNTY COURT AT LAW NO. 2 OF NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi and the owner of Parcel 26, Bayfront Open Space Park Project, have heretofore been unable to agree on the value of the said parcel, and authorization was given to acquire said parcel through eminent domain proceedings; and WHEREAS, Condemnation Cause No. 657, styled City of Corpus Christi v. Edith Seeger, involving Parcel No. 26, was set for trial and heard before Special Commissioners on August 18, 1972, and after making preliminary motions and arguments it was deemed in the best interest of the City to.effect settlement; and [AREAS, a value of the property was agreed upon between the owner and the City, and based on the agreement, further trial of the case was withdrawn: .7 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby appropriated out of the No. 291 Park Bond Fund the sum of $9,527, applicable to Project No. 291 -70-8, Bayfront Open Space Park Site #3, for additional compensation for acquisition of Parcel 26, owned by Edith Seeger, being a matter in condemnation in the County Court at Law No. 2 of Nueces County, Texas, styled City of Corpus Christi v. Edith Seeger, Cause No. 657. SECTION 2. The necessity to immediately appropriate the sum described above for the purpose of taking possession of the aforesaid parcel and proceeding with the Bayfront Open Space Park Project without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such 119,52 0 1 1 0 ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the day of March, 1974.
