HomeMy WebLinkAbout11958 ORD - 03/20/19740 JRR:jkh:hb:3 /18 /74:lst AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A LEASE AGREEMENT WITH THE CORPUS CHRISTI IN- DEPENDENT SCHOOL DISTRICT FOR THE USE OF WASH- INGTON ELEMENTARY SCHOOL FOR THE ESTABLISHMENT AND OPERATION OF A MULTI - PURPOSE SENIOR CENTER, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARRED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • SECTION 1. That the City Manager be and he is hereby authorized to enter into a lease agreement with the Corpus Christi Independent School District for the use of Washington Elementary School for the establishment and operation of a multi - purpose senior center, all as more fully set forth in the agreement, a copy of which is attached hereto and made a part hereof, marked Exhibit "A ". SECTION 2. The necessity to authorize the City Manager to enter into the aforesaid agreement at the earliest practicable date in order that the multi- purpose senior center may be established for the elderly citizens of the community creates a public emergency and an im- perative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the sus- pension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED this the ,&-"iay of March, 1974. ATTEST: "Ll-rl C ty Secrets APPROVED: .90 DAY OF MARCH, 1974: City Attorney " 1� .J%% 50ar 9:-t� MAYO THE CITY OF CORPUS CHRISTI, TEXAS JRR:MI.M:hb:3 /19/74:1st • CONTRACT THE STATE OF TEKAS X COUNTY OF Nl1ECES X THIS CONTRACT, by and between the Corpus Christi Independent School District, hereinafter referred to as the "District" and the City of Corpus Christi, Texas, a municipal corporation and body politic, operating under the home rule statutes of the State of Texas hereinafter referred to as "City ". W I T N E S S E T H: WHEREAS, City desires to assume the responsibility of establish- ing a multi- purpose center at the building known as the Booker T. Washington Elementary School; and WHEREAS, City is in the process of establishing a multi- purpose senior center in that area of the City; and WHEREAS, said building would adequately serve the elderly population as a senior center as well as providing other needed services; and WHEREAS, said building is presently vacant and unused by District; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and District do enter into the following agreement: I. District agrees to lease said building known as the Booker T. Washington Elementary School to City for a term of 364 days. Said term shall begin upon the effective date of this agreement. City agrees to pay, as consideration for said lease, the sum of $1.00, receipt of which by District is hereby acknowledged. II. City shall assume the responsibility for payment of all utili- ties and shall perform routine maintenance on said building. City further agrees to maintain liability and property damage insurance in amounts equivalent to its general coverage. F?W di i "A III. City shall have the right to sub -lease any portion of the school building for the delivery of community services, subject to approval of District. IV. District shall allow the use of all equipment and furniture pres- ently within the building, provided that District may remove furniture and equipment for use elsewhere in the District as the need arises. V. Any major modifications to the building or grounds by City shall be subject to approval by District. VI. Either party hereto may cancel this lease by giving the other party sixty (60) days written notice. Notice under this section may be served on the City by certified mail at P. 0. Box 9277, Corpus Christi, Texas 78408 and served on the District by certified mail at 515 N. Carancahua, Corpus Christi, Texas 78401. VII. City shall return building to District in the same condition as received except for usual wear and tear, such condition to be as re- flected by pictures and joint inspection made by both parties at the effective date of the lease. VIII. City and District mutually agree that the agents and employees of each shall not be considered agents and employees of the other and neither City nor District shall be liable for injury sustained by an agent or employee of the other. Marvin Townsend, City Manager APPROVED: DAY OF ,1974: City Attorney Corpus Christi, Texas i TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
