HomeMy WebLinkAbout11967 RES - 03/27/1974I * JRR:hb:3 /25/74:lst 0 A RESOLUTION MAKING FINDINGS REGARDING THE COST OF TREATED WATER FOR THE PERIOD OCTOBER 1, 1971 TO OCTOBER 1, 1976, AS SO PROVIDED IN THE CONTRACT BETWEEN REYNOLDS METALS COMPANY AND THE CITY OF CORPUS CHRISTI DATED OCTOBER 5, 1951; AND DECLARING AN EMERGENCY. WHEREAS, the Council has heard and taken into account all of the reports, opinions, statements and data submitted to the Council con- cerning the redetermination of the cost of treated water for the period October 1, 1971, to October 1, 1976, by the City of Corpus Christi and Reynolds Metals Company and the City of Corpus Christi dated October 5, 1951; and WHEREAS, Reynolds Metals Company and the City of Corpus Christi have agreed that the cost of treated water, as redetermined under such contract, is 13.2 cents per 1,000 gallons for the period October 1, 1971, to October 1, 1976. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The matter of the redetermination of the cost of treated water by the City of Corpus Christi and Reynolds Metals Company having been considered by the City Council, it is found that the cost of water to be furnished by City to Reynolds Metals Company at Calallen, Texas, under the contract between Reynolds Metals Company and the City of Corpus Christi, computed by using an incremental cost basis and limiting the computation to the cost of raw water and the treatment thereof, is 13.2 cents per 1,000 gallons for the period commencing October 1, 1971, and ending October 1, 1976. SECTION 2. The necessity for immediate determination of the cost of water under the Reynolds Metals Company contract to clarify the billings of the Water Division of the City of Corpus Christi Utilities Department creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the 11967 City Council, and the Mayor having declared such emergency and necessity to exist. having requested the suspension of such Charter rule and that this resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the a day of March, 1974.
