BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, AMENDING ORDINANCE NO. 11921 AUTHORIZING THE ISSUANCE OF $205,000.00 CITY OF CORPUS CHRISTI TAX AND REVENUE CERTIF- ICATES OF OBLIGATION, SERIES 1974; AND ORDAINING OTHER MATTERS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the construction of improvements to the Lawrence Street T -Head Marina Facilities is required as soon as possible and without delay for necessary and urgently needed public improvements; and that said meeting was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Annotated.Civil Statutes, Art. 6252 -17, as amended: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the ninth recital in the preamble of Ordinance No. 11921 is hereby amended to read as follows: "WHEREAS, the governing body of the City of Corpus Christi deems the construction of improvements to the Lawrence Street T -Head Marina Facilities to be necessary or convenient for the proper operation of the ports or harbors of such City and therefore such City is authorized by Vernon's Ann. Civ. St. art. 1187e to secure and pay bonds by and from the Pledged Revenues as hereinafter defined; and" SECTION 2. That Subsection (b) of Section 8 of Ordinance No. 11921 is hereby amended to read as follows: "(b) The term 'Pledged Revenues', as used in this Ordinance, shall mean all gross revenues derived by the City from the ownership and operation of the Marina Facilities except those revenues derived from the Peoples Street T -Head band shell and related concessions, less the reasonable expenses of maintaining and operating said facilities and improvements." SECTION 3. That all other provisions of Ordinance No. 11921 shall remain in full force and effect as passed and approved. SECTION 4. That all ordinances and resolutions or parts thereof in conflict herewith are hereby repealed to the extent of such conflict. oil • SECTION 5. The fact that the contemplated construction of improve- ments to the Lawrence Street T -Head Marina Facilities is necessary for the orderly development and growth of the City of Corpus Christi, Texas, creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule providing that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolution shall be read at three several meetings of the City Council and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 27th day of March, 1974. Civ. St, art. 6252 -17, as amended. I further certify that at the time said Ordinance was passed amending Ordinance No. 11921 the officers and Com- missioners of the City of Corpus Christi, Texas, were as follows: Jason Luby, Ricardo Gonzalez, Capt. Howard Stark THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the 27th day of March, 1974, the City Council of the City of Corpus Christi, Texas, convened in Regular Meeting, with the following members of said Council present, to -wit: Jason Luby, Mayor, Ricardo Gonzalez, Capt. J. T. Acuff, Rev. Harold T. Branch, Commissioners, Thomas V. Gonzales, Gabe Lozano, Sr., J. Howard Stark, T. Ray Kring, City Secretary, with the following absent:d constituting a quorum, at which time the following among other business was transacted: Mayor Jason Luby presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council, a communication in writing pertaining to said proposed ordinance, as follows: Corpus Christi, Texas 27th day of March, 1974 "TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas "For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City :1969 Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council. Respectfully, /s/ Jason Luby, MAYOR THE CITY OF CORPUS CHRISTI, TEXAS" Commissioner 41 moved that the Charter provi- sion prohibiting ordinances from being passed finally on the date introduced be suspended for the reasons stated in the written request of the Mayor and stated in the emergency clause of the ordinance. The motion was seconded by Commissioner r�44"— - The motion was carried by an unanimous vote by the City Council, viz: AYES: Commissioners Gonzalez, Acuff, Branch, Gonzales, Lozano, Sr., and Stark. NAYS: None. The Mayor requested that the records show that he voted Aye. This was done. Commissioner 4_ moved that the ordinance be passed finally.
