AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH HELDENFELS BROTHERS FOR CONSTRUCTION OF LAMAR
SCHOOL AREA STREET AND STORM SEWER IMPROVFIENTS,
UNITS I AND II, PROJECT NO. 220 -67 -92.8; APPROPRIATING
$650,000 OUT OF NO. 220 STREET BOND FUND, OF GFr1ICH
AMOUNT $621,878.20 IS FOR THE CONSTRUCTION CONTRACT
AND $28,121.80 IS FOR CON-1INGENCIES AND INCIDENTAL
EXPENSES, ALL APPLICABLE TO THE AFORESAID PROJECT;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to execute a contract with Heldenfels Brothers for construction of Lamar
School Area Street and Storm Sewer Improvements, Units I and II, Project
No. 220 -67 -92.8, all as is more fully described in the plans and specifi-
cations and contract documents on file in the office of the City Secretary,
all of which are made a part hereof by reference and according to the bid
of Heldenfels Brothers, opened on the 6th day of February, 1974, said bid
of Heldenfels Brothers being the lowest and most advantageous to the City
of Corpus Christi.
SECTION 2. There is hereby appropriated out of the No. 220
Street Bond Fund the sum of $650,000, of which $621,878.20 is for the
construction contract and $28,121.80 is for contingencies and incidental
expenses, all applicable to the aforesaid project.
SECTION 3. The necessity to execute the aforesaid contract and
to appropriate the sums hereinabove set out at the earliest possible date
in order that construction may be commenced without delay creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor
having declared such emergency and necessity to exist, and having requested
the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force

I certify to the City Council that $ 650,000 , the amount recuired
for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
