HomeMy WebLinkAbout11993 ORD - 04/10/1974JRR:jkh:4 -9 -74; 1st • AN ORDINANCE CLOSING AND ABANDONING THE 10 -FOOT UTILITY EASEMENT IN LOT 2, PARKDALE VILLAGE ANNEX C; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot utility easement in Lot 2, Parkdale Village Annex C, as shown by map of record in Volume 29, page 12 of the Map Records of Nueces County, Texas; and WHEREAS, the aforesaid easement is not now needed by the City, nor will it within the foreseeable future be needed by the City of Corpus Christi for any purpose whatsoever; and WHEREAS, it has been determined that it is to the advantage of the City to abandon the easement hereinabove described soi%at the same may be used by the owners of the abutting property for other purposes and increment the value of the City's ad valorem tax rolls: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 10 -foot utility easement located in Lot 2, Parkdale Village Annex C, in the City of Corpus Christi, Nueces County, Texas, more particularly described as follows, be and the same is hereby closed for public use and every municipal purpose and abandoned to the owners of the abutting property, in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas: Being a 10 -foot wide utility easement out of Lot 2, Parkdale Village Annex C, a map of which is recorded in Volume 29, page 12 of the Map Records of Nueces County, Texas; Beginning at the most westerly north corner of said Lot 2, and the most westerly corner of Lot 1, on the southeast boundary of Gollihar Road; Thence S. 580 53' 50" W., 60.72' to the point of curvature of a curve to the right which has a radius of 675.06' and continuing in a southwesterly direction along said curve a distance of 47.95' for the most northerly corner and place of beginning of the tract herein being described; Thence S. 31° 06' 10" E., 131.60'; N. 58° 53' 50" E., 44.15'; S. 31° 06' 10" E., 101.83'; S. 58° 53' 50" W., 28'; S. 31° 06' 10" E., 75'; N. 58° 53' 50" E., 28'; S. 31° 06' 10" E., 40' to the most easterly corner of this tract; I r I• • Thence S. 58" 53' 50" W., 10' to the most easterly southeast corner of this tract; Thence N. 310 06' 10" W., 30'; S. 580 53' 50" W. 281; N. 310 06' 10" W., 95'; N. 580 53' 50" E., 28'; N. 31° 06' 10" W., 81.83'; S. 58° 53' 50" W., 44.15'; N. 31° 06' 10" W., 142.39' to a point on a curve on the southeast boundary line of Gollihar Road for the most westerly corner of this tract; Thence in a northeasterly direction on said curve to the left, - which has a central angle of 00 51' 05 ", a radius of 675.06', for a distance of 10.03' to the point of beginning, this tract superseding that certain tract described in Volume 1326, page 488 of the Deed Records of said county, containing 4540.0 square feet of land, more or less. SECTION 2.. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. - SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the of April, 1974.
