AN ORDINANCE
AUTHORIZING ACCEPTANCE OF A RIGHT OF WAY EASEMENT
FOR HORNE ROAD IMPROVEMENTS, McARTHUR TO NAPLES
STREET, BEING PROJECT NO. 220 -70 -111, FROM THE
OWNERS, W. A. HORNE, ET AL; APPROPRIATING OUT OF
NO. 220 STREET BOND FUND $1,625 FOR ACQUISITION OF
THE AFORESAID RIGHT OF WAY EASEMENT; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. Authorization is hereby given for acquisition by the City
of a right of way easement for Horne Road, McArthur to Naples Street, Street
Improvements, being Project No.220 -70 -111, from the owners of Parcel No. 8
of the said project, said ownership being in W. A. Horne, et al, the said
parcel or tract being more fully described as follows:
Being an irregularly shaped tract of land out of Lot 1, Section
D, Paisley's Subdivision of the Hoffman Tract, as shown by map
of record in Volume A, page 28, Map Records, Nueces County,
Texas, said tract of land being more particularly described by
metes and bounds as follows:
Beginning at the most northerly corner of Block B-4, Port Ayers
Suburban Center, as shown by map of record in Volume 25, page 22,
Map Records, Nueces County, Texas, said point being S. 280 19' 10"
W., 40.0 feet from the Northeast boundary line of said Lot 1, and
the centerline of Horne Road, for the most Southerly and beginning
corner of the tract herein described;
Thence N. 610 40' 50" W., with a line that is 40.0 feet Southwest
of and parallel to the Norhteast boundary line of said Lot 1,
and the centerline of said Horne Road, a distance of 108.72
feet to a point in the original Southeast right -of -way flare-
out of the Crosstown Expressway (Highway 286) at Horne Road, for
a corner of the tract herein described;
Thence S. 710 59' 47" E., with the original South right -of -way
flare -out of the Crosstown Expressway (Highway 286) at Horne
Road, a distance of 83.76 feet to a point for a corner of the
tract herein described;
Thence S 610 40' 50" E., with a line that is 25.0 feet Southwest
of and parallel to the Northeast boundary line of said Lot 1,
and the centerline of said Horne Road, a distance of 17.91 feet
to a point for the Northeast corner of the tract herein described;
Thence S. 00 56' 10" E., with the Northerly extension of the
west boundary line of said Block B -4, a distance of 17.19 feet
to the point of beginning.
Containing 949.7 square feet•of land more or less.
A map of which is marked "Exhibit A" and attached hereto and made -
a part hereof for all purposes.

SECTION 2. There is hereby appropriated out of the No. 220
Street Bond Fund the sum of $1,625 for the acquisition by the City of
the aforesaid parcel of land from the owners, to be used for right of
way easement. in connection with the Horne Road Street Improvements aforesaid.
SECTION 3. The necessity to immediately authorize the acceptance
of the aforesaid right of way easement in order that the Horne Road improvements
may be commenced without delay creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the City
Council, and the Mayor having declared such emergency and necessity to exist,
and having requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

I certify to the City Council that $ 1,625.00 , the amount required
for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi
to the credit of:

Project Name Horne Road, Naples to Columbia Street
Improvement Project
from which it is proposed to be drawn, and such money is not appropriated for
any other purpose.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement_ and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
