HomeMy WebLinkAbout11998 ORD - 04/10/1974• JRR:MLM:jkh;4- 10 -74; 1st TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH GULF COAST TESTING LABORATORIES FOR TESTING SERVICES ON FIVE SUBDIVISIONS ON PADRE ISLAND, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, • SECTION 1. That the City Manager be, and he is hereby, authorized and directed to enter into an agreement with Gulf Coast Testing Laboratories for testing services on five subdivisions on Padre Island, all as more fully set forth in the agreement, a copy of which is attached hereto and made a part hereof. SECTION 2. The necessity to enter into the aforesaid agreement at the earliest practicable date in order that subdivision development may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of April, 1974. ATTEST• k—',- ft� City Secretar AP ROVED: DAY OF APRIL, 19 : City Attorney MAYOR THE CITY OF CORPUS CHRISTI, TEXAS H• • ., CONTRACT THE STATE OF TEXAS COUNTY OF NUECES This contract by and between the City of Corpus Christi, a municipal corporation and body politic, operating under the home rule statutes of the State of Texas, hereinafter referred to as City, and Gulf Coast Testing Laboratories, hereinafter referred to as Gulf Coast: WITNESSETH: WHEREAS, City desires to have certain tests performed in connection with Padre Island Project No. 1 within.the following subdivisions: Commodore's Cove Unit 1; Island Fairway Estates; Block 19, Port 0' Call; Barataria Bay Units 1, 2, 3, 4 and 5; and Point Tesoro Units 1, 2, 3, 4 and 5; and WHEREAS, the Platting Ordinance as specifically amended by Ordinance No. 11742 requires testing as hereinafter described: NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and Gulf Coast do enter into the following agreement: I Gulf Coast agrees to perform the following testing services at the direction of City at the following prices: Item Descriation Thru 1974 1975 Remainder of Project In -Place Densities, Each $ 15.00 $ 16.20 $ 17.50 Proctors, Each 65.00 70.00 75.00 Atterberg Limits & Gradation, Each 33.50 36.00 39.00 Design, Each 250.00 270.00 290.00 Extraction, Each 60.00 65.00 70.00 Densities, Each 30.00 32.50 35.00 Concrete Cylinders Made by Urban's Inspector and picked up by Laboratory, Each cylinder 8.00 8.65 9.35 Trip Charge 21.00 22.50 24.50 II Gulf Coast and City hereby specifically agree that this is a unit price contract and that City shall only be liable for actual tests performed. tX W `' • III City may cancel this contract for any reason by giving 30 days written notice to Gulf Coast at P. 0. Box 1148, Corpus Christi, Texas, 78403. IV Should other laboratory tests be required than those specifically set forth above, City will reimburse Gulf Coast at the current unit price for the individual test performed. V Gulf Coast agrees to indemnify and hold harmless City from any liability and /or claims arising out of the execution of this contract. Marvin Townsend City Manager GULF COAST TESTING LABORATORY By President General Manager Corpus Christi, Texas t� day of , 19 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
