HomeMy WebLinkAbout12000 ORD - 04/17/1974HG:hb:4 116/74:2nd API ORDINANCE AMENDING ORDINANCE NO. 8879, AS AMENDED, BY ADDING PARAGRAPH "F" TO SECTION 6.32 THEREOF SO AS TO AUTHORIZE ISSUANCE OF PERMITS TO REENTER A PLUGGED AND ABANDONED WELL FOR PUR- POSE OF CASING RECOVERY ONLY; DESIGNATING REQUIRED INFORMATION ON SAID PERMIT APPLICATION; REQUIRING REPLUGGING AND ABANDONING OF SAID WELL; REQUIRING PERMITTEE SHALL COMPLY WITH ALL CITY ORDINANCES AND PARTICULARLY THE AFORESAID ORDI- NANCE NO. 8879. AS AMENDED: REOUIRING A BOND; REQUIRING SWORN AFFIDAVIT APPLICANT HAS PER- MISSION FROM THE OWNER OF SAID CASING TO REMOVE SAME; PROVIDING FOR SEVERANCE; AND PROVIDING FOR PUBLICATION. WHEREAS, many wells within the City of Corpus Christi have been plugged and abandoned in accordance with the provisions of Ordinance No. 8879, as amended, commonly referred to as the Land Drilling Ordinance; and WHEREAS, currently there is a shortage of casing pipe to the extent that such shortage is impeding the discovery and production of additional oil and gas; and WHEREAS, presently no procedure exists for reentering a plugged and abandoned well for the purpose of casing recovery; and WHEREAS, the recovery of said casing will assist the oil and gas industry in increasing production of oil and gas in this area. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 8879, passed and approved by the City Council on May 29, 1968, and as amended, commonly referred to as the Land Drilling Ordinance, be and the same hereby is amended by adding a new paragraph to Section 6.32 thereof to be designated as paragraph "F" to read as follows: "F. Whenever it is desired to reenter a plugged and abandoned well for the purpose of casing recovery only an application shall be made in writing to the Petroleum Superintendent. Such application shall be accompanied by a permit fee of one hundred dollars ($100). Such application shall request a permit to reenter a formerly plugged and abandoned well 12000 and give the name and number of such well and its location. Such appli- cation shall indicate the status of the well outlining the casings set in the well and how said well was previously plugged and abandoned. The application shall also indicate the size and the amount of casing proposed to be recovered followed by an affirmative statement that after recovery of the casing the applicant will plug and abandon the well in accordance with the existing requirements of plugging and abandonment as contained in this Ordinance, as amended, commonly referred to as the Land Drilling Ordinance. Applicant for a permit hereunder must be a bona fide operator or service company and bonded and insured as required in subsections 7.1 and 7.2, of this Ordinance. Applicant shall also comply with all other applicable City ordinances and in particular, but not limited to, the provisions of this Ordinance; as amended. Applicant shall also provide to the Petroleum Superintendent a sworn affidavit that applicant has per- mission from the owner of the casing to be removed, to remove same. Upon full compliance with all provisions of this subsection, the Petroleum Superintendent is authorized to issue a permit for the purpose of casing recovery only for the designated well and to insure that said well is plugged and abandoned after such recovery in accordance with the applicable City ordinances." SECTION 2. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance sball be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, para- graph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
