A RESOLUTION
WHEREAS, certain property owners of Edroy, Texas contemplate an
application to the Texas Water Rights Commission for permission to create
a special water district under the State Water Code to install certain water
and sewer facilities on the hereinafter described property; and
WHEREAS, the community of Edroy and the subject property lies
within the extraterritorial jurisdiction of the City of Corpus Christi; and
WHEREAS, V.A.T.S., Article 970a, Section 8B and the Texas Water
Code Sec. 54.016 requires approval or disapproval of the creation of the said
district by the City in whose extraterritorial jurisdiction they are situated;
and
WHEREAS, the proposed Edroy facilities are not in accordance with
the minimal standards required by Code of the City of Corpus Christi but,
as represented to the City, would be in accordance with minimal Farm and Home
Administration standards; and
WHEREAS, there is a pressing public need for water and sewer
facilities and service for existing buildings and uses on the subject property
In the community of Edroy:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City of Corpus Christi hereby expresses its
approval of proposed water and sewer facilities for the hereinafter described
property, to -wit:
Beginning at a point in the South line of the SAU &G
Railroad right of way one hundred feet West (100' W)
of the intersection of such railroad right of way with
the West line of Avenue F of the town of Edroy according
to plat recorded in Vol. 2 page 19, Map Records of San
Patricio County, Texas, for -the place of beginning;
Thence S 90 30' W, parallel with the West line of Avenue F,
a distance of 788.2 feet;
Thence S. 800 30' E, at 100 pass the southwest corner of the
intersection of Avenue F and Fifth Street, continuing along
the south line of Fifth Street in all a distance of 1180
feet to west line of Main Avenue;
Thence S. 9° 30' W with the West line of Main Avenue a distance
of 409 feet;

Thence S. 800 30' E across Main Avenue, at 60 pass the South---
West corner of Tract 9 Heuermann Subdivision per plat recorded
in Volume 3, page 16, Map Records of San Patricio County, Texas,
continuing along the South line of Tract 9, in all a distance
of 360 feet;
Thence N 9° 30' E, 409 feet to a point in the South line
of Fifth Street;
Thence S 80° 30' E, along the South line of Fifth Street,
1665.8' more or less, to a point 60 feet southwesterly
from the West right -of -way line of Interstate Highway 37;
Thence parallel with and 60' from the West line of I.H. 37
with the following calls S 290 21' E 277 feet, S 710 20' E
134.5 feet, S 290 21' E 519.5 feet, more or less, to a point
in the West line of the Easternmost roadway shown on the
Heuermann Subdivision Map ( 40' road);
Thence S 90 30' W, with the west line of said road, a
distance of 3109.3 feet more or less to a point opposite
the southwest corner of the Martin Nestler Subdivision of
the NW quarter of Section 8 of the Cubage and Miller Subdivision;
Thence S 80° 30' E, across said 40 road, and along the south
line of said Martin Nestler Subdivision, a distance of 2494.7
feet to a point in the right of way of I.H. 37;.
Thence northwesterly along the R.O.W. of I.H: 37 with the
following calls: N 290 21' W 1849.43' to the P.C. of a curve
to the left having a radius of 1592.28'; around said curve
289.18 feet to the P.T.; N 390 45' W, 200 feet to the beginning
of a curve to the right having a radius of 1682.28'; around
said curve 55.89 feet to a point in the line between Sections
8 and 11 of the Cubage and Miller Subdivision;
Thence N 800 30' W along said line 901 feet to a point in the
east line of a 40 foot road and 20 feet easterly from the
common corner of Sections 8, 9, 10 and 11;
Thence N 90 30' E with the east line of said 40' road 1338.1
feet to the R.O.W. of I.H. 37;
Thence northwesterly along the R.O.W. of I.H. 37 with the
following calls: N 29° 21' W, 531.9' ; N 71° 20' W, 134.5';
N 29° 21' W, 2300'; N 12° 38' E. 134.5'; around a curve to
the left whose radius is 5669.65', a distance of 1132 feet
more or less to a point in the west line of Main Avenue;
Thence S 9° 30' W, with the west line of Main Avenue 1307.9
feet, more or less, to the Northeast corner of Block 16;
Thence N 800 30' W, along the South line of Third Street 280
feet to the Northwest corner of Block 16;
Thence S 90 30' W, with the East line of Avenue D, 297 feet
to its intersection with the North line of Railroad Avenue;
Thence N 790 58' W with the North line of Railroad Avenue
880 feet, to a point 100 feet West of the West line of
Avenue F;
Thence S 90 30' W, across Railroad Avenue and the SAU &G
Railroad right of way, 160 feet to the place of beginning,

provided that said water and sewer facilities to be furnished by such
district to said existing buildings and uses meet at least minimal Farm
and Home Administration Standards.
It is further provided that any water and sewer facilities and
service to future development in Edroy meet at least the minimal standards
for water and sewer facilities of the Code of the City of Corpus Christi.
SECTION 2. The necessity to express approval of proposed water and
sewer facilities for the properties hereinabove described in order that such
urgently needed facilities may be installed as soon as possible creates a
public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, and having requested the
suspension of the Charter rule and that this resolution be passed finally
on the date of its introduction and take effect and be in full force and
effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
