AN ORDINANCE
AUTHORIZING THE CITY MANAGER OR HIS AUTHORIZED
REPRESENTATIVE TO EXECUTE LEASE AGREEMENTS WITH THE
TENANTS OF VARIOUS BUILDINGS LOCATED ON PROPERTY
ACQUIRED BY THE CITY, SAID LEASES TO BE ON A MONTH -
TO -MONTH BASIS, ALL AS MORE FULLY SET FORTH IN THE
FORM OF LEASE AGREEMENT, A COPY OF WHICH IS ATTACHED
HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A ";
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager or his authorized representative
be and he is hereby authorized to execute Lease Agreements with the tenants
of various buildings located on property acquired by the City, said leases
to be on a month -to -month basis, all as more fully set forth in the form of
lease agreement, a copy of which is attached hereto and made a part hereof,
marked Exhibit "A ".
SECTION 2. The necessity to adopt as soon as practicable a policy

for the leasing of buildings located on property acquired by the City creates
a public emergency and an imperative public necessity requiring the suspension
of the Charter rule that no ordinance or resolution shell be read at three
several meetings of the City Council, and the Mayor having declared that such
emergency and necessity exist, and having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of April,
1974.

PROPERTY RENTAL CONTRACT
I
This contract made the day of , 19_,
between the City of Corpus Christi, Texas, a home rule City and municipal
corporation under the lave of the State of Texas, hereinafter referred to
as "Landlord" and , here-
inafter called "Tenant ".
W I T N E S S E T H:
The Landlord does hereby rent a certain building, No. ,
on (Street) in the City of Corpus
Christi, Texas on a month -to -month basis, commencing on the day of
19 at a monthly rental of
Dollars ($ ), payable in advance on the
first day of each month.

Tenant agrees as follows:
1. To pay each month's rent as it becomes due. Rent is due on
the day of each month, and check or money order for the full amounts
will be delivered or mailed to
Corpus Christi, Texas so
as to reach Landlord before 5:00 P.M. on the due date. No rents will be
refunded unless agreement is terminated by Landlord without cause.
In addition thereto, it is hereby agreed as follows:
1. That the Tenant shell pay the Landlord said rent in the manner
hereinbefore specified, and shall not let or underlet the whole or any pert
of said premises, nor sell or assign this contract, either voluntarily or
by operation of law, nor allow said property to be occupied by anyone contrary
to the terms hereof, without the written consent of the Landlord.
2. That should said rent be not paid when due or should the Tenant
default in any of the covenants and conditions contained herein the Landlord
or his representative or agent, may re -enter said premises and remove all
persons therefrom without notice or resort to any proceeding at law, for
which Tenant hereby acknowledges receipt in hand of additional good and
valuable consideration for this covenant.
That Tenant shall pay all utilities and service fees for the demised
premises, or for assessments thereon or connected therewith, including but
not limited to water, gas, electricity, garbage disposal, and telephone
services.
3. That Tenant shall occupy said demised premises and shall keep
the same in good condition, including such improvements as may be made thereon
hereafter, the usual weer and tear, and damage by elements excepted, and shell
not make any alterations thereon without the written consent of Landlord and
shall not commit or suffer to be committed any waste upon said premises.
4. That all governmental laws and ordinances shall be complied
with by Tenant.
5. That should the nature and character of occupancy of said
premises, by Tenant, cause the fire and liability insurance rates applicable
thereto to be increased, Tenant shall pay the difference upon the amount of
fire and liability insurance now being carried by Tenant and said difference
shall be in addition to the amount of rental specified herein and shall be
paid to Landlord upon demand.
6. That should Landlord be compelled to commence or sustain an
action at law to collect said rent or parts thereof or to dispossess Tenant
or to recover possession of said premises, Tenant shall pay ell costs in
connection therewith including a reasonable fee for the attorney of Landlord
in such actions.
7. That the waiver by Landlord of any covenant or condition herein
contained shall not vitiate or waive the same or any other covenant or con-
dition contained herein and that the terms and conditions contained herein
shall apply to and bind the heirs, successors and assigns of the respective
parties hereto.
8. That should Tenant occupy said premises after the expiration
date of this contract, with the consent of Landlord, expressed or implied,
such possession shall be construed to be a tenancy from month to month and

said Tenant shall pay said Landlord for said premises the sum of

($ ) per month for such period as said Tenant may remain in posses-
sion thereof.
9. That said premises shell not be used by Tenant during the
term of this contract for other than
purposes except with the written consent of Landlord.
10. That at the expiration of said term or the sooner termination
thereof, Tenant shall peacefully quit and surrender possession of said premises
in as good condition as reasonable use and wear thereof will permit.
11. Landlord shall not be liable for any injury or damage to any
person or to any property at any time on said premises or building from any
cause whatever which may arise from the use of or the conditions of said
premises or building or from ice thereon, or from water, rain, snow or gas
which may leak into, issue or flow from any part of said building, or from
the pipes or the plumbing of the same, from electrical malfunctions or defects
thereof, or from any other place or quarter, or from any other cause, during
said term or any renewal thereof. Tenant expressly agrees to and hereby does
release Landlord and the agent of Landlord from any liability whatever arising
in any way out of the management by it or him of the property herein rented,
or by reason of the actions of the agent in enforcing at law or otherwise the
terms and provisions of this contract.
12. Tenant expressly understands and agrees that any personal
property left in or on the rented premises for more than thirty (30) days
after the termination of occupancy under the terms hereof shall become the
property of Landlord, the City of Corpus Christi, and shall be disposed of by
the City of Corpus Christi in any manner it deems appropriate.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally an the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
