HomeMy WebLinkAbout12022 ORD - 04/24/19740 JRR:vp:4 /23/74:1st • AN ORDINANCE AUTHORIZING EMINENT DOMAIN PROCEEDINGS TO CONDEMN FEE TITLE TO A CERTAIN TRACT OF LAND LOCATED IN NUECES COUNTY, TEXAS; DESCRIBING SAID PROPERTY, IDENTIFYING THE RECORD TITLE OWNERS AND CITING LIEN - HOLDERS OF RECORD, SAID CONDEMNATION BEING NECESSARY FOR THE ACQUISITION OF PARCEL NO. 9 FOR THE HORNE ROAD IMPROVEMENTS, MCARTHUR TO NAPLES STREET, PRO- JECT NO. 220 -70 -111; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS AGAINST THE RECORD OWNERS, JOE P. BADER AND WIFE, NELL CLARKS BADER; AND DECLARING AN EMERGENCY. WHEREAS, it is necessary to acquire, for and on behalf of the City Of Corpus Christi, a certain parcel or tract of land described as follows: and PARCEL NO. 9 Being an irregularly shaped tract of land out of Lot 16, Section G, Paisley's Subdivision of the Hoffman Tract, as shown by map of record in Volume A, Page 28, Map Records, Nueces County, Texas, said tract of land being more particularly described by metes and bounds as follows: Beginning at a point, at the intersection of the west right of way line of 100 foot wide Port Avenue and the existing northeast right of way line of Horne Road for the southeast and beginning corner of the tract herein described; Thence N. 61° 40' 50" W., with the northeast right of way line of said Horne Road which is 25.0 feet northeast of and parallel to the southwest boundary line of said Lot 16 and center line of Horne Road a distance of 168.60 feet to a point for a corner of the tract herein described; Thence N. 52° 31' 05" W., with the original north right of way Flare -out of Highway 286 (crosstown expressway) at Horne Road, a distance of 94.20 feet to a point for a corner of the tract herein described; Thence S. 61° 40' 50" E., with a line that is 40.0 feet northeast of and parallel to the southwest boundary line of said Lot 16 and the centerline of said Horne Road, a distance of 219.07 feet to a point, the point of a curve for a corner of the tract herein described; Thence in a northeasterly direction with the are of a curve to the left whose central angle is 1190 15' 20", and whose radius is 20.0 feet, a distance of 41.63 feet to a point, the point of said curve is the west right of way line of said Port Avenue for a corner of the tract herein described; Thence S. 00 56' 10" E., with the west right of way line of said Port Avenue, a distance of 51.32 feet to the point of beginning. Containing 3,429.8 square feet of land more or less. WHEREAS , the necessity for the completion of Horne Road Improve- meats, McArthur to Naples Street, and other municipal purposes, requires the acquisition of the aforesaid parcels of lend; and 12022 WHEREAS, record title to the aforesaid parcels appears to be in the following: Joe P. Bader and wife, Nell Clarke Bader; and WHEREAS, the City of Corpus Christi, Texas, is unable to arrive at an agreement with the said owners and claimant as to the price and value of said parcel, and damages for the taking thereof by the City; it is, there- fore, determined by the City Council that it is necessary that said lots or parcels of land described be acquired through the exercise of the City's power of eminent domain for said public purpose: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. In accordance with the City Charter and the laws of the State of Texas, the City of Corpus Christi, Nueces County, Texas, does hereby order, direct and authorize that eminent domain proceedings be insti- tuted for the purpose of acquiring the aforesaid parcels of land and premises, excluding mineral interests, for use by the City for Horne Road Improvements, McArthur to Naples Street, Project No. 220 -70 -111, and for other municipal purposes, and to condemn the fee simple title to the aforesaid parcels or tracts of land, excluding mineral interests. SECTION 2. The City Attorney of the City of Corpus Christi is hereby authorized and directed to institute proceedings against the said property, and against all persons who appear to have an interest therein, and to proceed with said condemnation suit to its final conclusion and to obtain possession and title to said property for use in the Horne Road Improvements, McArthur to Naples Street and for other municipal purposes. SECTION 3. The public importance and necessity for the City to gain immediate possession and title of the aforesaid parcels or tracts of land hereinabove described for the Horne Road Improvements and for other municipal purposes, as hereinabove described and provided, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of -2- 0 0 its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ,-)�'d ey of April, 1974.
