AN ORDINANCE AUTHORIZING ACCEPTANCE OF A RIGHT -OF -WAY DEED AND DEDICATION FOR HORNE ROAD UNIT II IMPROVEMENTS, McARTRUR TO NAPLES STREET, BEING PROJECT NO. 220 -70 -111, FROM THE OWNERS, JOE P. BADER AND WIFE, NEIL BADER; APPROPRIATING OUT OF NO. 220 STREET BOND FUND $7,546 FOR ACQUISITION OF THE AFORESAID RIGHT -OF -WAY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be, and he is hereby, authorized to accept from the owners, Joe P. Bader and wife, Nell Bader, a Right -of -Way Deed and Dedication for Horne Road Unit II Improvements, McArthur to Naples Street, being designated as Project No. 220 -70 -111, said parcel or tract being more particularly described as follows: Being an irregularly shaped tract of land out of Lot 16, Section G., Paisley's Subdivision of the Hoffman Tract, as shovm by Map of Record in Volume A. Page 28, Map Records, Nueces County, Texas, said tract of land being more particularly described by metes and bounds as fo]1ows: Beginning at a point,. at the intersection'of the west right of way line of 100 foot wide Port Avenue and the existing northeast right of way line of Horne Road_for the southeast and beginning corner of the tract herein described; Thence N. 610 40' 50" W., with the northeast right of way line of said Horne Road which is 25.0 feet northeast of and parallel to the Southwest boundary line of said Lot 16 and centerline of Horne Road, a distance of 168.60 feet to a point for a corner of the tract herein described; Thence N. 520 31' 05" W., with the original north right of way flare - out of Highmay 286 (Crosstown Expressway) at Horne Road, a distance of 94.20 feet to a point for a corner of the tract herein described; Thence S. 610 40` 50" E., with a line that is 40.0 feet northeast of and parallel to the southwest boundary line of said Lot 16 and the centerline of said Horne Road, a distance of 219.07 feet to a point, the P.C. of a curve, for a corner of the tract herein described; Thence in a northeasterly direction with the are of a curve to the left whose central angle is 1190 151• 20 ", and whose radius is 20.0 feet, a distance of 41.63 feet to a point, the P.T. of said curve is the west right of way line of said Port Avenue for a corner of the tract herein described; Thence S. 00 56' 10" E., with the west right of vray line of said Port Avenue, a distance of 51.32 feet to the point of beginning. Containing 3429.8 square feet of land more or less. SECTION 2. The necessity to authorize the acceptance of the afore- said Right -of -Way Deed and Dedication in order that.the Horne Road Unit II Improvements may proceed without delay creates a public emergency and an 12039 0 0 imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED , this the day of May, 1974• ATTEST /: G � t City Secret APPROVED: DAY OF MAY, 1974 City Attorney MAYOR THE CITY OF CORPUS CHRISTI, TEXAS ii CITY OF CORPUS CHRISTI, TEXAS CERTIFICATION OF FUNDS r (City Charter Article IV Section 21) f May 1, 1974 I certify to the City Council that $ 7,546.00 , the amount required for the contract, agreement, obligation or expenditures contemplated in the above and foregoing ordinance is in the Treasury of the City of Corpus Christi to the credit of: Fund No. and Name Project No. 220 Street Bond Fund 220 -70 -111 Project Name Horne Road Unit II, McArthur to Naples Street Improvement Project from which it is proposed to be drawn, and such money is not appropriated for any other purpose.
