HomeMy WebLinkAbout12055 RES - 05/15/1974JRR:e:oc:5 /15/74 1st A RESOLUTION PETITIONING THE LEGISLATURE OF THE STATE OF TEXAS, 64TH REGULAR SESSION, TO ESTABLISH BY ITS ACT A STATE PUBLIC UTILITIES REGULATORY COMMISSION, AND PARTICULARLY ADDRESSING THE LEGISLATORS REPRESENTING THE CITY OF CORPUS CHRISTI, THE HONORABLE MIRE MCRINNON, DISTRICT 20, HONORABLE L. DeWITT HALE, DISTRICT 48, PLACE 1, HONORABLE JOE SALEM, REPRESENTATIVE, DISTRICT 48, PLACE 3, HONORABLE LEROY J. WIETING, REPRESENTATIVE, DISTRICT 41, AND HONORABLE CARLOS F. TRUAN, REPRESENTATIVE, DISTRICT 48, PLACE 2; SPECIFICALLY CALLING FOR AN ADEQUATE AND EXPERT COMMISSION STAFF AND SUFFICIENT FINANCING TO PERFORM ITS DUTIES IN AN OUTSTANDING MANNER; RECOMMENDING THAT THE ELECTRIC, TELEPHONE, TELEGRAPH, AND OIL AND GAS TRANSMISSION AND DISTRIBUTION UTILITIES BE MADE SUBJECT TO THE COMPLETE REGULATION OF SAID COMMISSION WITHIN THE BOUNDARIES OF THE STATE OF TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi within the past • two years has been petitioned by the Central Power s Light Company and the Southwestern Bell Telephone Company for increases in the rates and charges of said companies for the services rendered by them in the City of Corpus Christi; and WHEREAS, the City Council of the City of Corpus Christi has experienced great difficulty and the City of Corpus Christi has incurred exorbitant costs in receiving, reviewing, conducting hearings, analyzing and evaluating, with the assistance of retained experts, the requests made by the companies, to the public detriment; and WHEREAS, it is the conclusion of this City Council that a city in this State cannot well afford to incur the cost and expend the time entailed in performing the regulatory functions of these utilities in a fair and competent manner; and WHEREAS, the City of Corpus Christi and the Corpus Christi Municipal Gas Corporation have been compelled to partic- ipate in the present hearings before the Railroad Commission of the State of Texas, at great cost and expense to the City, in the rate application and curtailment proceedings involving the Lo -Vaca Gathering Company, the sole gas supplier of the City of Corpus Christi and the Corpus Christi Municipal Gas Corporation; and 12055 WHEREAS, it is the consensus of the City Council that the regulatory function relative to the electric, telephone, telegraph, and oil and gas transmission and distribution utilities can be best performed and most economically accomplished by a permanent, adequately and expertly staffed and well - financed State Public Commission with the result that the public interest will be better served and, by virtue of the uniform, statewide regulation, the utilities affected will be able to function with a considerable saving in staff time and direct expense; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Legislature of the State of Texas, and more particularly the Honorable Legislative Delegation representing the City of Corpus Christi, be hereby petitioned to secure the final passage of an Act in the 64th Regular Session of the Legislature to establish a permanent State Public Utilities Commission adequately and expertly staffed and well - financed, to regulate within the boundaries of the State of Texas all electric, telephone, telegraph, and oil and gas transmission and distribution utilities. SECTION 2. That duly certified copies of this Resolution be forthwith transmitted to the Honorable Legislative Delegation representing the City of Corpus Christi, Texas, by the City Secretary of the City of Corpus Christi, Texas. PASSED this 15th day of May, 1974, in the City of Corpus Christi, Texas in a Regular Meeting of the City Council in the Council Chamber of the City Hall. Ci Attorn y Corpus Christi, Texas day of 19 T TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
