AN ORDINANCE
CLOSING THAT PORTION OF ROSE STREET RIGHT OF WAY AT
ITS INTERSECTION WITH NUECES BAY BOULEVARD, AS MORE
FULLY DESCRIBED HEREINAFTER; AUTHORIZING THE CITY
MANAGER TO EXECUTE QUITCLAIM DEEDS TO THE OWNERS OF
PROPERTY ABUTTING SAID PORTION OF ROSE STREET HEREBY
CLOSED; PROVIDING FOR SEVERABILITY; AND DECLARING
AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing con-
cerning the closing of a portion of Rose Street, at its intersection with
Nueces Bay Boulevard, as more fully described hereinafter, was given by
Publication and registered mail to the last known addresses of the owners of
property abutting said street and within 450 feet of the area to be closed
and thereafter, pursuant to said notice, public hearing was held at Regular
Council Meeting on Wednesday, May 8, 1974, in accordance with the provisions
of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing
that it would best serve the public convenience and necessity to close the
portion of Rose Street hereinafter more fully described:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CIS' OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the hereinafter described portion of Rose Street,
situated in the City of Corpus Christi, be and the same is hereby closed for
public use and abandoned to the owners of the abutting property:
TRACT I
Being an irregularly shaped tract of land out of a portion of
Rose Street, as shown by Barthlome Addition recorded in Volume
6, Page 11, Map Records, Nueces County, Texas, said tract of
land being more particularly described by metes and bounds as
follows:
Beginning at a point in the southeast right -of -way line of
said 80 foot wide Nueces Bay Boulevard, at its intersection
with the east right -of -way line of Rose Street for the northeast
and beginning corner of the tract herein described;
Thence South 30 40' 20" East, with the east right -of -way line of
said Rose Street, a distance of 77.63 feet to a point, the P.C.
of a circular curve for a corner of this tract;

Thence in a southwesterly direction with the arc of a circular
curve to the right whose central angle is 600 00', whose radius
is 60.0 feet, an arc distance of 62.83 feet to a point in the
centerline of now closed Rose Street for the most southerly
corner of the tract herein described;
Thence North 30 40' 20" West, with the extension of the center-
line of said Rose Street, a distance of 52.45 feet to a point
for an interior corner of the tract herein described;
Thence North 550 58' West, a distance of 23.43 feet to a point
the southeast right -of -way line of said Nueces Bay Boulevard,
for the most westerly corner of the tract herein described;
Thence North 340 02' East, with the southeast right -of -way line
of said Nueces Bay Boulevard, a distance of 79.37 feet to the
point of beginning.
Containing 3208.2 square feet of land more or less.
TRACT II
Being an irregularly shaped tract of land out of a portion of
Rose Street, as shown by Barthlome Addition as recorded in
Volume 6, Page 11, Nap Records, Nueces County, Texas, said
tract being more particularly described by metes and bounds as
follows:
Beginning at a point in the southeast right -of -way line of 80
foot wide Nueces Bay Boulevard, at its intersection with the
Nest right -of -way line of said Rose Street when extended
northerly for the point of beginning of the tract herein de-
scribed;
Thence North 340 02' East, with the southeast right - of-way
line of said Nueces Bay Boulevard, a distance of 18.74 feet
to a point for the most northerly corner of the tract herein
described;
Thence South 550 58' East, a distance of 23.43 feet to a point
in the centerline of Rose Street when extended northerly for the
northeast corner of the tract herein described;
Thence South 30 40' 20" East, with the centerline of said Rose
Street, a distance of 52.45 feet to a point in the arc of cir-
cular curve for the southeast corner of the tract herein de-
scribed;
Thence in a westerly direction with the arc of said circular
curve to the right whose central angle in 590 27' 20 ", whose
radius is 60.0 feet, an arc distance of 62.26 feet toaa point
the P.C.C. of curves for a corner of this tract;
Thence in a southwesterly,direction with the arc of a circular
curve to the left whose central angle in 810 45' and whose
radius is 9.95 feet, and arc distance of 14.20 feet to a point,
the P.T. of said curve and in the southeast right -of -way line of
said Nueces Bay Boulevard, for the southwest corner of the
tract herein described;
Thence North 340 02' East, with the southeast right -of -way line
of said Nueces Bay Boulevard, a distance of 69.24 feet to the
point of beginning.
Containing 3152.0 square feet of land more or less.

SECTION 2. That the City Manager is hereby authorized, for and
on behalf of the City of Corpus Christi, to execute Quitclaim Deeds to the
owners of property abutting the portion of Rose Street hereinabove described.
SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word, or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word,
or provision hereof be given full force and effect for its purpose.
SECTION 4. The necessity to immediately close the aforesaid portion
of Rose Street at its intersection with Nueces Bay Boulevard for use as a
public street and to abandon the same to the owners of abutting property,
in order that the aforesaid portion of Rose Street may be used for other
purposes, creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared that such emergency and necessity exist, and
having requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect and be in
full force and /effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
