HomeMy WebLinkAbout12083 ORD - 05/22/1974ORDINANCE NO. 120,63 BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION; AND ORDAINING OTHER MATTERS RELATING TO THE SUBJECT; AND DECLARING AN EMERGENCY. WHEREAS, it is hereby officially found and determined that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the publication of Notice of Intention to Issue Certificates of Obligation to provide proceeds for the construction of an airport tower expansion is required as soon as possible and without delay for necessary and urgently needed public improvements; and that said meeting was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Vernon's Ann. Civ. St. art. 6252 -17, as amended. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That attached hereto and marked "Exhibit A" is a form of notice, the form and substance of which are hereby passed and approved. Section 2. That the City Manager shall cause said notice to be published, in substantially the form :attached hereto, in the Corpus Christi Times, a newspaper of general circulation in the City of Corpus Christi, Texas, for two consecutive weeks, the date of the first publication to be May 22, 1974, which date is at least fourteen (14) days prior to the day tentatively proposed for authorizing the issuance of the Certificates of Obligation as shown in said notice. Section 3. The fact that the contemplated construc- tion of an airport tower expansion is necessary for the orderly development and growth of the City of Corpus Christi, Texas, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the date it is introduced and that such ordinance or resolu- tion shall be read at three several meetings of the City Council and the Mayor having declared that ,uch public emergency and imperative necessity exist, and having requested that said Charter Rule be suspended and that this ordinance take effect and be in full force and effect from and after its passage, it is according- ly so ordained. Section 4. That all ordinances and resolutions or parts thereof in conflict herewith are hereby repealed. Christi, "EXHIBIT A" NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION NOTICE IS HEREBY GIVEN that it is the intention of the City Council of the City of Corpus Christi to issue the interest bearing certificates of obligation of the City entitled "City of Corpus Christi Tax and Revenue Certificates of Obligation, Series 1974 -A," for the purpose of paying the contractual obligation to be incurred by the City under a contract for the construction of an airport tower expansion in said City. The City Council tentatively proposes to authorize the issuance of said Certificates of Obligation at its regular meeting place in the City Hall at a Special meeting to commence at 11:00 o'clock, A.M., on the 5th day of June, 1974. The maximum amount of Certificates of Obligation indebtedness that may be authorized for such purpose is $800,000. The City Council presently proposed to provide for payment of such certificates by the levy of taxes and from revenues derived from the City from the ownership and operation of such airport tower expansion. Howard Stark THE STATE OF TEXAS COUNTY OF NUECES CITY OF CORPUS CHRISTI On this the 22nd day of May, 1974, the City Council of the City of Corpus Christi, Texas, convened in Regular Meeting, with the following members of said Council present, to -wit: Jason Luby, Mayor, Ricardo Gonzalez, Capt. J. T. Acuff, Rev. Harold T. Branch, Commissioners, Thomas V. Gonzales, Gabe Lozano, Sr., T. Ray Kring, City Secretary, with the following absent: Z constituting a quorum, at which time the folld&ng among other business was transacted: Mayor Jason Luby presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor presented to the Council, a communi- cation in writing pertaining to said proposed ordinance, as follows: "Corpus Christi, Texas May 22, 1974 "TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas "For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City 12083 Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council. Respectfully, MAYO %%a Pro -iew a THE CITY OF CORPUS CHRISTI, TEXAS" Commissioner Acuff moved that the Charter provision prohibiting ordinances from being passed finally on the date introduced be suspended for the reasons stated in the written request of the Mayor and stated in the emergency clause of the ordinance. The motion was seconded by Commissioner Branch. The motion was carried by an unanimous vote by the City Council, viz: AYES: Commissioners Gonzalez, Acuff, Branch, Gonzales, and Lozano, Sr. NAYS: None. The Mayor requested that the records show that he voted Aye. This was done., Commissioner Acuff moved that the ordinance be passed finally. The motion was seconded by Commissioner Branch. The motion was carried by the following vote: AYES: Commissioners Gonzalez, Acuff, Branch, Gonzales, and Lozano, Sr. NAYS: None. The Mayor requested that the records show that he voted Aye. This was done. The Mayor announced that the ordinance had been passed. The ordinance is as follows:
