HomeMy WebLinkAbout12089 ORD - 05/29/1974JRR:MLM:e:5 /29/74: 1st TEXAS: AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING SECTION 9 -76 THEREOF SO AS TO MORE CLEARLY DEFINE THE AREAS COVERED BY SAID SAID SECTION; AND BY AMENDING SECTION 9 -78 OF SAID CODE SO AS TO PROVIDE A "NO WAKE" ZONE ACROSS THE INLET TO LAKE CORPUS CHRISTI STATE PARK; REPEAL- ING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the Corpus Christi City Code, 1958, as amended, be and the same is hereby amended by amending Section 9 -76 thereof to here- after read as follows: "Sec. 9 -76. Activities Prohibited in Certain Areas; Markings of Such Areas. No swimming, fishing, boating, hunting, picnicking or other recreational activities will be permitted downstream from the center line of the old Corpus Christi Dam or within a radius of fifty (50) feet of any buoy except in those areas managed and supervised as public recreational areas. The old Corpus Christi Dam may be utilized for fishing from its surface area as long as it is made a part of a public recreational area. and under the management and supervision of the parties responsible for the public recreational area." SECTION 2. That the Corpus Christi City Code, 1958, as amended, be and the same is hereby amended by amending Section 9 -78 thereof by adding to subsection (A) thereof a new paragraph which will read as follows: "There is hereby designated a "NO WAKE" zone across the inlet to Lake Corpus Christi State Park as defined by buoys erected and maintained by the State Park and Wildlife Department." SECTION 3. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, pr provision of this ordinance shall be held invalid or unconsti- tutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this Ordinance, stating in substance the purpose of the ordinance. 12089 SECTION 6. The necessity to make the changes herein above set out so as to more clearly define the areas covered in Section 9 -76 of the Corpus Christi City Code, 1958, as amended, and to provide for the designation of a "NO WAKE" zone within the limits defined in Section 9 -78 of said Code creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, and publication, IT IS ACCORDINGLY SO ORDAINED this thee-7-909 day of 1974. , ATTEST: i City Secre ary APPROVED: 29t, H DAY OF MAY 1 � 1Ad � �111A A fif&�1ki Cit�yVAtto ney MAYOR THE CITY OF CORPUS CHRISTI, TEXAS • Corpus Christi, Texas day of 19,Z TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
