AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI'ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
SKYLAND DEVELOPERS, BY AMENDING THE ZONING MAP BY
CHANGING THE ZONING ON 1.869 ACRES OUT OF LOT 1,
SECTION 28, FLOUR BLUFF AND ENCINAL FARM AND GARDEN
TRACTS, AS MORE FOLLY DESCRIBED HEREINAFTER, SITUATED
IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
FROM "R -lA" ONE FAMILY DWELLING DISTRICT TO "B -3"
BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER
PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND
IN PARTICULAR REPEALING ORDINANCE NO. 12025,
DECLARING AN EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City
Council its reports and recommendations concerning the application of
Skyland Developers for amendment
to the zoning map of the City of Corpus Christi; and
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before
the City Council of the City of Corpus Christi, in accordance with proper
notice to the public, said public hearing having been held on Wednesday,
_April 24, 1974 , at Special Council Meeting of the City
Council in the Council Chamber at City Hall in the City of Corpus
Christi; and
WHEREAS, by motion. duly made, seconded and carried, it was
decided by the City Council that to approve the hereinafter set forth
amendment would best serve public health, necessity and convenience and
the general welfare of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHF.ISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed on the,27th day of August, 1937, appearing of
record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution
Records, as amended from time to time, and in particular as amended by
Ordinance No. 6106, as amended, be and the same is hereby amended by
making the change hereinafter set out.

SECTION 2. That the zoning of the 1.869 acres out of Lot 1, Section
28, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of
Corpus Christi, Nueces County, Texas, more particularly described hereinafter,
be and the same is hereby changed from "R -IA" One Family Dwelling District
to "B -3" Business District:
Eeing a tract of land situated in Corpus Christi, Nueces County, Texas out of
Lot 1. Section 28. Flour Bluff and Encinal Farm and Garden Tracts as shown on
the plat recorded in Val ama A at Paga 43 of the Map Records of Nueces County,
Texas and being more particularly described by metes and bounds as follows;
Commencing at the northwest corner of Lot 1, Section 28.
said point being the common corner of Sect9ons 17. 18.
28 and 29 and also the intersection of the centerlines
of McArdle and Rodd Field Roads; .
THENCE S 29° 06' 10" W along the centerline of Rodd Field
Road, the west line of Lot 1. Section 28, a distance of
627.4 feet to a point, said point being the west corner
of a tract of land conveyed by warranty deed from John
William Farley et ux to Timothy W. Martin et al, dated
4- 20 -71, recorded in Volume 1396, Page 331, Deed Records
of Nueces County, Texas;
THENCE S 600 53' 50" E along the southwest boundary line
of said Timothy W. Martin et al tract a distance of 20.0
feet to a point in the east right- of -amy of Rodd Field
Road for the point of beginning and the northwest corner
of this tract;
THENCE S 62° 31' 01" E continuing along said southwest
boundary line of the Timothy W. Martin et al tract a
distance of 145.69 feet to a point for the northeast
corner of this tract, said point lying in the west
boundary of Lot 2, Block A, Joslin Tract as shown on
the plat recorded in Volume 40 at Page 2 of the Map
Records of Nueces County, Texas and being the south
corner of the Timothy W. Martin et al tract;
THENCE S 29' 02' 29" W along said west boundary of
Lot 2, Block A, Joslin Tract, a distance of 593.37
feet to a point for the southeast corner of this tract,
said point lying in th_ north right -of -way line of
South Padre Island Drive;
THENCE N 36" 30' 50" 11 along said north right -of -way
line of South Padre Island Drive, a distance of 160.59
feet to a point for tho southwest corner of this tract
said point being at the intersection of the north right -
of -way line of South Padre Island Drive +iith the east
right -of -way line of Rodd Field Road;
THENCE N 29° 06' 10" E along the'east right -of -way
line of Rodd Field Road, a distance of 522.95 feet
to the point of beginning, forming a tract of land
embracing 1.869 acres.

SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as
amended from time to time, except as herein changed, shall remain in
full force and effect.
SECTION 5. That all ordinances or parts of ordinances in con-
flict herewith are hereby expressly repealed, and particularly repealing
Ordinance No. 12025.
SECTION 6. That the necessity of immediately making aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and
an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date
of its introduction and that such ordinance or resolution shall be read
at three several meetings of the City Council, and the FAyor having
declared that such emergency and necessity exist, and having requested
the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full
force and effect from and after its passage. IT IS ACCORDINGLY SO

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
