HomeMy WebLinkAbout12099 ORD - 05/29/1974JRR:RWC:jkh:cd:5- 28- 74:lst AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF LYNN GRAY (.runt WHEELER. TRUSTEE) BY CHANGING THE ZONING FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT ON THE MIDDLE ONE - THIRD AND TO A -2 ON THE EAST ONE -THIRD OF THE SOUTH- WEST 749.89 FEET OF BLOCK 4, J. C. RUSSELL FARM BLOCKS, ALL AS MORE FULLY DESCRIBED HEREINAFTER; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Lynn Gray (Jim Wheeler, Trustee) for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on October 17, 1973, at Regular Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW THEREFORE, BE IT ORDAINED BY'-THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 12099 SECTION 2. That the zoning of the middle 1/3 and the East 1/3 of the Southwest 749.89' of Block 4, J. C. Russell Farm Blocks, situated in the City of Corpus Christi, Nueces County, Texas, more particularly described hereinafter, be and the same is hereby changed as follows: from "R -1B" to "B -4" on the middle 1/3 and to "A -2" on the East 1/3 of the south west 749.89', said respective tracts or parcels being more particularly described as follows: MIDDLE 1/3 Being 14.8 acres of land, more or less, being portions for Lots 1 and 2, Block 4, J. C. Russell Farm Blocks as shown by map recorded in Volume 28, Page 58, Map Records of Nueces County, Texas; BEGINNING on the North right -of -way line of Bear Street (formerly Kosar Road) for the Southeast corner of this tract from which said Southeast corner the intersection of said North right -of -way line of Bear Street and the West right -of -way line of Flato Road bears North 89 °56'00" East 700 feet, more or less; THENCE South 89 °56100" West, along said North right -of -way line of Bear Street, same being the South boundary line of said Lots 1 and 2, Block 4, 694 feet, more or less, to the present I -2 zoning line for the Southwest corner of this tract; THENCE in a Northerly direction along the present I -2 zoning line with a curve having a radius of 1545.00 feet, more or less, for an arc distance of 802.88 feet, more or less, for the North- west corner of this tract; THENCE East 961.00 feet, more or less, for the Northeast corner of this tract; THENCE South 750.71 feet, more or less, to the POINT OF BEGINNING and containing 14.8 acres of land, more or less. EAST 1/3 Being 12.05 acres of land, more or less situated in Lot 2, Block 4, J. C. Russell Farm Blocks as shown by Map recorded in Volume 28, Page 58, Map Records of Nueces County, Texas; BEGINNING at the intersection of the West right -of -way line of Flato Road and the North right -of -way line of Bear Street (formerly Kosar Road) for the Southeast corner of this tract; THENCE South 89 °56'00" West, along the North right -of -way line of said Bear Street, 700.00 feet, more or less, for the Southwest corner of this tract; THENCE North 750.71 feet, more or less, for the Northwest corner of this tract; THENCE East 700.00 feet, more or less, to the West right - of -way line of said Flato Road for the Northeast corner of this tract; THENCE South, along the West right -of -way line of said Flato Road, 749.89 feet, more or less, to the POINT OF BEGINNING and containing 12.05 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage.
