AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN
AMENDMENT TO THE AGREEMENT WITH PAGE, SODTHERLAND,
PAGE & WRITTET FOR ARCHITECTURAL SERVICES IN
CONNECTION WITH THE CORPUS CHRISTI INTERNATIONAL
AIRPORT TOWER EXPANSION, THE AGRRMIENT HAVING BEEN
AUTHORIZED BY ORDINANCE NO. 10790, DATED APRIL 12,
1972, SAID AMENDMENT TO PROVIDE FOR AN EXPANDED
SCOPE OF SERVICES, INCLUDING DESIGN FOR THE EN-
CLOSURE OF THE PASSENGER BOARDING GATES AND A
REVISED FEE SCHEDULE FOR THE ARCHITECTS' SER-
VICES, ALL AS MORE FULLY SET FORTH IN THE AMEND-
ED AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO
AND MADE A PART HEREOF, MARKED EXHIBIT "A ';
REVERTING ALL APPROPRIATIONS OF SAID ORDINANCE NO.
10790 AND APPROPRIATING OUT OF NO. 245 AIRPORT
BOND FUND THE SUM OF $56,880, OF WHICH $49,380 IS
APPLICABLE TO THE AIRPORT TOWER EXPANSION, PROJECT
NO. 245 -74 -1, AND $7,500 IS APPLICABLE TO THE
PASSENGER BOARDING GATES, PROJECT NO. 245- 68 -19;
AND DECLARING AN EMERGENCY. '
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:

SECTION 1. That the City Manager be and he is hereby authorized
to execute an amendment to the agreement with Page, Southerland, Page &
Whittet for architectural services in connection with the Corpus Christi In-
ternational Airport Tower Expansion, the agreement having been authorized
by Ordinance No. 10790, dated April 12, 1972, said amendment to provide
for an expanded scope of services, including design for the enclosure of the
passenger boarding gates and a revised fee schedule for'the Architects'
services, all as more fully set forth in the amended agreement, a copy of
which is attached hereto, marked Exhibit "A ", and made a part hereof.
SECTION 2. That all sums appropriated by Ordinance No. 10790
be reverted to the No. 245 Airport Bond Fund, and there is hereby appropri-
ated $56,880 out of the No. 245 Airport Bond Fund, of which $49,380 is
applicable to the Airport Tower Expansion, Project No. 245 -74 -1, and $7,500
is applicable to the,Passenger Boarding Gates, Project No. 245- 68 -19.
SECTION 3. The necessity to authorize execution of an amend-
ment to the agreement for Airport Tower Expansion and appropriation of the
funds hereinabove set forth for the purposes outlined creates a public
emergency and an imperative public necessity requiring the suspension of the

Charter rule that no ordinance or resolution shall be passed finally on the
date of its introduction and that such ordinance or resolution shall be
read at three several meetings of the City Council, and the Mayor having
declared such emergency and necessity to exist, having requested the sus-
pension of the Charter rule and that this ordinance take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO

This amended Agreement is made and entered into this day of
, 1974 by and between the City of Corpus Christi, Texas,
a municipal corporation, acting herein by and through its City Mana.ger� duly
authorized to act, hereinafter called the "City" and Page, Southerland, Page
& Whittet, architects, a partnership, hereinafter called the "Architect ".
W I T I V E S S E T H
THAT WHEREAS, the present contract with the Architect for the F.A.A.
Tower is based on a m:xim,m set fee based on a budget of $400,000.00, and
WiiFIM.. the increased scope of the F.A.A. Tower and the delays
caused for the construction not attributed to the Architect's negligence,
has resulted in a cost higher than that originally anticipated, and
WAF.AFnS, the City intends to contract certain improvements to
the Corpus Christi International Airport facilities, more specifically the
enclosure and air conditioning of the boarding gates.
I.
A. Architect has completed design and will provide general supervision
of construction of the F.A.A. Tower project in accordance with all
other provisions of the contract, except as amended below.
B. Architect agrees to- provide professional services for the enclosure
and air conditioning of the boarding gates in accordance with the
Architect's services as listed below: °
1. Architect's services include, but not limited to.the following:
Necessary conferences with City and F.A.A.; preparation of pre-
liminary studies; working drawing; large scale and full size
detailed drawing for architectural, structural, plumbing, elec-
trical, heating ventilation and air conditioning; the drafting
of forms of proposal and contracts; the checking of shop draw-
irigs; the issuance of certificates of payment; the keeping of

amounts; the general supervision of the business of the work.
The Architect shall have preliminary plans within 30 days for
review by the City and shall have final plans prepared within
90 days from the date of authorization by the City.
II. The City agrees to pay the Architect for the services as stipulated
in the original contract and as amended in Section I and I B above,
seven and one -half percent (7-21%) of the cost of the work based on the
estimated actual cost until such time as the actual construction cost
is determined by letting a contract or contracts for the F.A.A. Tower
portion or the enclosure and air conditioning of the boarding gates
portion.
III. All other conditions of the original agreement pertaining to payments,
termination clan e. assignability, etc. of contract or generally re-
ferred to as Section 2 through 10 shall apply.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
