HomeMy WebLinkAbout12112 ORD - 06/05/1974• JRR:jkh:6 -5 -74; 1st • TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS FOR ACQUISITION OF PORTION OF LOT 5, BLOCK 3, BOHEMIAN COLONY LANDS, MORE PARTICULARLY DESCRIBED HEREINAFTER, FOR CONSTRUCTION OF A RAILROAD SPUR FOR THE MUNICIPAL SERVICE CENTER AND A MATERIALS YARD FOR THE STREET DIVISION AND OTHER CITY OPERATIONS; REVERTING TO THE RESERVE FUND ACCOUNT OF THE NO. 123 GENERAL REVENUE SHARING FUND $29,958 OF THE $500,000 APPROPRIATION MADE FOR THE PURCHASE OF LANDFILL EQUIP- MENT BY ORDINANCE NO. 11624 AND$45,000 OF THE $315,000 APPROPRIATION MADE BY ORDINANCE NO. 11624 AND REAPPROPRI- ATED BY ORDINANCE NO. 11953 FOR THE CONSTRUCTION OF SOUTH STAPLES STREET IMPROVEMENTS, FROM PADRE ISLAND DRIVE TO SARATOGA BOULEVARD; APPROPRIATING OUT OF THE NO. 123 GENERAL REVENUE SHARING FUND $74,958, OF WHICH AMOUNT $74,500 IS FOR LAND ACQUISITION AND $458 IS FOR INCIDENTAL EXPENSE RELATED TO CLOSING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute the necessary documents for acquisition of the hereinafter more particularly described portion of Lot 5, Block 3, Bohemian Colony Lands, situated in the City of Corpus Christi, Nueces County, Texas, from the owners, Fin, L.T.D., to be used for construction of a railroad spur for the Municipal Service Center and a materials yard for the Street Division and other City operations, said parcel or tract being more particu- larly described as follows: A tract of ]end . out of Lot 5, Block 3, Bohemian.Colomy Lands as shown on the map or plat thereof Volume A, Page 48, Piueces County Ma?_ Records, and being more particularly described by metes acd bounds as follows; Beginning at a point in the Northeast right of way line of the Texas-Me-tiican Railroad N_A. S. Spurr said point being N. 290 01' 18" E., 20.0 feet and s_ 610 30' E., 1415.0 feet from the Southwest corner of said Lot 5, for the Southwest and beginning corner of the tract herein described; Thence N. 290 01' 18" E., with the Southeast line of the M_ B. Roddy Tract, a distance'of 819.69 feet to a point for the Northwest corner of the tract herein described; Thence S. 610 30' E., a distance of 518.60 feet to a point for the Northeast corner of the tract herein described; 12111`, Thence S. 290 oil 3-8" W., with the Northwest line of the City Of Corpus Christi tract, a distance of 819.69 feet to a point in the Northeast right of may line of said N. A. S. Railroad Spur for the southeast corner of the tract herein described; - Thence N. 610 30' W., with the Northeast right of tray line of szid N.A.S. Railroad Spur, a distance of 518.60 feet to the .point of beginning. Containing 9.76 acres of land more or less. SECTION 2. That there is hereby reverted to the Reserve Fund Account of No. 123 General Revenue Sharing Fund $29,958 of the $500,000 appropriation made for the purchase of landfill equipment by Ordinance No. 11624 and $45,000 of the $315,000 appropriation made by Ordinance No. 11624 and reappropriated by Ordinance No. 11953 for the construction of South Staples Street Improvements, from Padre Island Drive to Saratoga Boulevard. SECTION 3. There is hereby appropriated out of the No. 123 General Revenue Sharing Fund $74,958, of which amount $74,500 is for land acquisition and $458 is for incidental expense related to closing, all in connection with the above described acquisition. SECTION 4. The necessity to authorize the execution of the necessary documents and to appropriate the sums necessary for the acquisi- tion of the parcel hereinabove described in order that.the project may proceed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction, but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule,that this ordinance be passed finally on the date of its introduction, and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the,;�_day of June, 1974.
