HomeMy WebLinkAbout12113 ORD - 06/05/1974isJRR:jkh:6 -5 -74 -1st • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUTMS 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF TOM SWANTNER, TRUSTEE BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON 38.218 ACRES OUT OF LOTS 17, 18, 31 and 32, SEC. 18, FLOUR BLUFF & EN SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT To "A -1" APARTMENT DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, .the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Tom Swantner, Trustee for amendment to the zoning map of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, ,lane 5, 1974 , at Soecial Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. 12113 SECTION 2. That the zoning on approximately 38.218 acres out of Lots 17, 18, 31 and 32, Section 18, Flour Bluff and Encinal Farm and Garden Tracts, situated in the City of Corpus Christi, Nueces County, Texas, be and the same is hereby changed from "R -1B" One Family Dwelling District to "A -l" Apartment House District, said tract being more particularly described as follows: FIELDNOTES for 38.218 acres, more or less, out of Ldts 17, 18, 31, and 32, Section 18, Flour Bluff & Encinal Farm and Garden Tracts in Nueces County, Texas; BEGINNING at the most southerly corner of Lot 31, Section 18 for the most•'southerly corner and POINT OF BEGINNING -of this tract; - THENCE with the southwest boundary line of Section 18, N.610 14 855.67 feet to a corner of this tract; THENCE N 290 02' E 446:69 feet to an interior corner of this tract; THENCE N 610 W 466.69 feet to a point in the northwest boundary line of Lot 32 of said Section 18.for a corner of this tract; THENCE with said boundary line N 290 02' E 848.15 feet to the most northerly corne6 of this tract whence the most northerly corner of Lot 32 bears N 29 02' E 10 feet; I THENCE in a southeasterly direction with a circular curve whose radius center bears N 290 E said curve having a central angle = 350 radius = 1230 feet, tangent = 387.81 feet, for an arc distance of 751.35 feet to the point of reverse curve of a circular-curve to the right; THENCE with said curve having a central•angle = 350, radius = 179.99 feet, tangent = 56.75 feet, for an arc distance of 109.95 feet to the point of tangency; THENCE S 610 E 117.63 feet to a point in the northwest boundary line of Block 2 of Woodlawn Estates II, Unit 1 shown by map filed in Volume 16, Page 3 of the map records of said county for a corner of this tract; THENCE with said boundary line S 290 W 158 feet to the most westerly corner of Lot 12, Block 2 of said Woodlawn Estates and an interior corner of this tract; THENCE S 610 E 396 feet to the most southerly corner of Woodlawn Estates, a point in the southeast boundary line of Lot 18 of said Section 18, and the most easterly corner of this tract; THENCE with said boundary line S 290 02' W at 87 feet pass the common corner of Lots 18 and 31 of said Section 18 and 1,324.85 X eet with the southwest boundary line of Lot.31 for a total distance of 1,411.85 feet to the POINT OF BEGINNING. i • SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August; 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage.
