HomeMy WebLinkAbout12133 ORD - 06/19/1974S JRR:e:oc:6 /18/74 • 1st , AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH SESSIONS MORTGAGE COMPANY, TRUSTEE, DEVELOPER OF RIDGEWOOD SUBDIVISION, UNIT I, IN CONNECTION WITH THE CONSTRUCTION OF STREET IMPROVEMENTS ALONG MALDEN DRIVE AND ST. ANDREWS DRIVE ADJACENT TO CITY PARRS, A COPY OF WHICH AGREEMENT IS ATTACHED HERETO, MARRED EXHIBIT "A" AND MADE A PART HEREOF; APPROPRIATING OUT OF NO. 220 STREET BOND FUND $13,015.19 REPRESENTING THE CITY'S SHARE OF COSTS FOR THE ABOVE DESCRIBED IMPROVEMENTS AS PROVIDED IN THE PLATTING ORDINANCE, APPLICABLE TO PROJECT NO. 220- 72 -18; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manger be, and he hereby is, authorized to execute an agreement with Sessions Mortgage Company, Trustee, developer of Ridgewood Subdivision, Unit 1, in connection with the construction of street improvements, along Malden Drive and St. Andrews Drive, adjacent to City parks, all as is more fully set forth in said Agreement, a copy of which is attached hereto, marked Exhibit "A ", and made a part hereof for all pertinent purposes. SECTION 2. That there is hereby appropriated out of No. 220 Street Bond Fund $13,015.19, representing the City's share of costs for the above described improvements, as provided in the Platting Ordinance, all applicable to Project No. 220- 72 -18. SECTION 3. That the necessity to authorize the execution of the above referenced Agreement and appropriate the funds necessary to cover the City's share as set out in said Agreement so that work may proceed in an orderly manner, creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect and be in 12133 JRR:e:oc:6 /18/74 • lst • full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /9 xday of June, 1974. The Developer will construct Malden Drive & St. Andrews nrioa along Ridgewood Park and Country Club Park This construction will be contracted for and financed by the Developer. 2. The City =Vicees to reimbLrse the Developer as its share for the cost o:° the above st=ated construction., including engineering, the sum of _Thirteen Thousand and ±ifteen & 19/100 D017- .cs (`13,015.19) Such reimbursement wiL be made by the City to the Developer upon completion and acceptance of the improvements by the City. 3. The Developer agrees to indemnify the City against any claims arising as a result of the project. �. This agreement shall be executed in duplicate, both of which shall be considered one instrument. Zdhen both of the duplicates have been executed by the City, and at least one duplicate has been executed by the Developer, this agreement shall become effective and shall be binding upon and sha11 inure to the benefit of the parties hereto and their respective heirs, successors and acs1,-ns. FIN 2 -55 Revised 7/31/69 • • Corpus Christi, Texas day of �iLvrc.Qi , 19 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
