AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH THE RESIDENTS COM--
MITTEE OF CAMDEN PLACE TO MAINTAIN AN ORNA-
MENTAL PLANTING STRIP ALONG CAMDEN PLACE ON
AIRLINE ROAD, IN ACCORDANCE WITH THE TERMS
AND CONDITIONS OF SAID AGREEMENT, A COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART
HEREOF, MARKED EXHIBIT "A -1 "; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is hereby,
authorized and directed to execute an Agreement with the Residents Committee
of Camden Place concerning maintenance of an ornamental planting strip
along Camden Place on Airline Road, in the City of Corpus Christi, Nueces
County, Texas, in accordance with the terms and conditions of said Agree-
ment, a copy of which is attached hereto and made a part hereof, marked
Exhibit "A -111.
SECTION 2. The necessity to authorize the execution of the
aforesaid Agreement as soon as possible in order that the above described
planting strip may be planted and underground irrigation system installed
creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction and that such ordinance or
resolution shall be read at three several meetings of the City Council,
and the Mayor, having declared such emergency and necessity to exist,
having requested the suspension of the Charter rule and that this ordinance
take effect and be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED this theday of June, 1974.

AGREEMENT
THE STATE OF TEXAS
KNOW ALL MEN BY THESE PRESENTS:
COUNTY OF NUECES
WHEREAS, the Residents Committee of Camden Place, an unin-
corporated association (a nonprofit Texas corporation), hereinafter
referred to as "CAMDEN ", agrees to develop, and the City of Corpus
Christi, a municipal corporation and body politic, incorporated under the
home rule statutes of the State of Texas, hereinafter called "CITY ",
agrees to maintain a planting strip on Airline Road, the parties do hereby
agree on the following:
ARTICLE I
The subject area is street right - of-way on the south side of Airline
Road extending between the fronting extremities of Camden Place along Airline
Road. The strip is approximately 1200 feet in length (excluding the two streets
entering Airline Road from Camden Place) and is approximately 15 feet in width
(including a 4 -foot concrete sidewalk), being a total of approximately .39 acres.
The subject area is totally City - owned, having been dedicated as right of way,
and is shown on Exhibit "B" attached hereto and made a part hereof.
ARTICLE II
Camden agrees to install a manually actuated underground irrigation
system, complete with necessary valves and sprinklers to allow effective opera-
tion and ground coverage, along with the necessary water taps. The specifications
for said irrigation system are attached hereto, marked Exhibit "A ", and made a
part hereof.
ARTICLE III
Camden agrees to do necessary soil preparation and plug with Saint
Augustine grass on the entire strip.
ARTICLE IV
Camden agrees to enforce the irrigation installer guarantee on
materials and workmanship for a period of one year after installation.
ARTICLE V
The attached plan and specifications (Exhibit "A ") for the work
to be done by Camden are a part of this agreement; the articles enumerated
above are for clarification and are not to be construed to make any part of
the attached plans and specifications invalid.
ARTICLE VI
The City agrees to maintain the irrigation system (not to be con-
sidered an invalidation of the irrigation system guarantee).
ARTICLE VII
The City agrees to operate the water system and maintain the planting
within the subject area equal to the level of service provided in other areas
of like nature being maintained by the City.
VIII
The City agrees to assume the cost of water for the subject
area, upon completion and written acceptance of the irrigation system,
executed by the City Manager and filed with the City Secretary.
IX
Improvement costs (irrigation, soil preparation, planting) on
the project shall be to the sole expense of Camden.
ARTICLE X
The City reserves the right to inspect all stages of development
of the project for both compliance to existing plans and specifications and
variation of construction and development techniques. The foregoing shall
only be with concurrence of the City and Camden, and shall not extend in time
or add to the cost of the project by Camden.
XI
Camden agrees that the City shall not be liable for losses
or damages incurred before the project has been accepted by the City.
ARTICLE XII
It is understood that Camden will not allow, at any time, the posting
of bills, political signs, or any form of advertising on the Camden wall along
Airline Road.

This agreement is to take effect after it is executed in
duplicate, each of which shall he considered an original, this the

CAMDEN PLACE /AIRLINE ROAD IMPROVEMENTS
UNDERGROUND SPRINKLER SYSTEM
SPECIFICATIONS
.PLANS, SPECIFICATIONS, AND INTENT
The plans, these specifications, -the proposal, special provisions and .
all supplementary documents are intended to describe a complete work,
and are essential parts of the contract. A requirement occurring in
any of then is binding. In case of discrepancies,'plans shall govern over
specifications. The contractor shall not take advantage of any apparent
error or omission in the plans and specifications and the-architect shall
be permitted to make such corrections, or interpretations as may be deem-
ed necessary for the fulfillment of the intent of the plan's and specifi-
cations. In the event the contractor discovers an apparent error or
discrepancy, he shall immediately call this to the attention of the
architect.
Manufacturer's specifications and installation instructions of all.equip-
ment supplied shall become a part of the specifications.
The cost of all labor and all materials, of whatever nature, incidental to
the completion of the improvements as shown or indicated on the plans or in
these specifications, shall be included within the contract price-
-.THE WORK SHALL INCLUDE:
Water piping and fittings, risers, solvent, solder, flux, sprinkler heads,
valves, water meters, final clean -up, and final check and adjustment of
total system to proper operation.
CITY` shall pay for all water utilized through the installed meters.
FINAL CLEAN -UP: ,
Upon completion of the work and before, acceptance is requested, the con-
tractor shall clean the site and remove rubish surplus and discarded mate-
rials, temporary structures and debris of every kind. Leave the site of
the work in a neat and orderly condition. Surplus and waste materials re-
moved from the site of the work shall be disposed of properly.
OiXE FULL PAYFLNT shall be made ;within 60 days, but after 30 days after
acceptance of the system by the o: -finer.

"OR EQUAL" CLAUSE:
Unless the clause "or equal" is used in the specifications pertaining to
a material or article, only the specified item shall be installed. If
pertaining to a material or article, the clause "or equal" is used in
the specifications the written approval of the architect shall be obtained.
Each and every item to be used in the work, and not meeting the exact
specification requirements, must be submitted for approval. Description
shall include a complete specification of the proposed substitute item
including data sheets and other information necessary to enable a full
and complete comparison of the proposed substitute with that of the
exact specified item. Such approval or disapproval shall be considered
final.
GUARANTEE AND MAINTENANCE
All materials and workmanship shall be fully guaranteed for one year
to be without defect. The installed system shall be fully guaranteed
for one year from date of acceptance to produce uniform distribution
and even coverage of moisture. Contractor shall promptly remedy all
such defects to contract requirements.
MAINTENANCE OF THE SYSTEM
As part of this contract, raising and lowering of heads for proper
operation shall be performed at no charge for one year from the
i acceptance of the installation.
MATERIALS
I POLYVINYL CHLORIDE PIPE AND FITTINGS

PVC Pipe shall have been manufactured in accordance with Commercial
Standard CS256 -63; and shall be Class 200 for Mainline piping, and
Class 200 for lateral piping. All PVC pipe shall be continuously
and permanently marked with the following information: Manufacturer's
name, pipe size, type of pipe and material, SDR Number or Schedule,
Commercial Standard Number and the National Sanitation Foundation Seal.
All PVC fittings shall be of the same material as the PVC pipe specified
and shall be compatible with the PVC pipe furnished.
COPPER TUBE AND FITTINGS
All copper tube shall be Type "M" or "L ", straight lengths.
All copper tube fittings shall be cast brass or wrought copper,
sweat- solder type. Such fittings shall be attached to the tubing
in proper manner, using 50 -50 soft solder.

GLOBE VALVES shall be brass, located and sized as shown on the plans and
shall be 100# type, Fig. No. 302X, as manufactured by Ohio Brass Company,
or approved equal, and shall be fitted with a key head for key operation.
POP -UP LAWN SPRAY HEADS shall be of the Lawnmaster Pop -up type, cast
bronze, Series 34 as manufactured by the Weater -matic Division of Telsco
Industries, or approved equal. The sealing seat between the barrel and
tail piece shall be metal to metal. The pop -up nozzle projection shall
be not less than 2" above the ground during operation. Nozzle shall
recede flush with the ground _plate_ whenat_ rest.

SHRUB SPRAY HEADS shall be P92 -100 series shrub spray heads as manufac-
tured by the Weater -Matic Division of Telsco Industries, or approved
equal. Approved equal must be of the same manufacturer as approved
equal lawn pop -up head. Construction shall be made from commercial brass
bar stock. Full circle shrub heads shall be provided in 24 ft. diameter
spray patterns. Part circle shrub heads shall be of two piece construc-
tion with separate nozzles adapted to the body by means of NOS straight
pipe threads so that nozzles can be turned in bodies for directional
control, said bodies to be reamed for 112" copper, sweat joint.
ALL SPRAY HEAD NOZZLES shall be precision milled to flow a precisely .
determined GPM at the manufacturer's recommended operating pressure.
No adjustable or "screw type" nozzles shall be approved by the.engineer
as a substitute for the specified items under the "or equal" clause.
RISERS for pop -up spray heads shall be-1/2" galvanized steel pipe with threaded
connections and fittings. Risers shall have thread connection for attachment to
the spray head. Exact length shall be determined in field and shall be of length
to permit installation of the spray head flush with the.finish grade. Threaded
connection shall be made on the riser.
INSTALLATION
EXCAVATION, BACKFILL a PROTECTION OF SHRUBBERY
All trenches shall be backfilled with the material removed and shall be
flooded in order to prevent aftersettling. Flooding shall be from the
bottom to the top of the trench. All mud shall then be worked to a
liquid consistency to prevent aftersettling.
After watersettling the ditches, all trenches and adjoining areas shall
be hand raked to leave grade to proper and uniform level.
Shrubs shall not be moved or damaged except in cases where it is impossible
to make the installation othen-jise, then shrubs may be moved, provided
ample precautions are taken to prevent damage to the shrubs.

It is understood that the piping layout is diagrammatic and piping shall
be routed around trees.and shrubs in such manner as to avoid damage to
plantings. Where tree roots are encountered, no root over 3/4" diameter
shall be cut.
PIPE INSTALLATION
SPRINKLER MAINS shall be installed in a minimum 4" wide trench with a
minimum of 15" cover.
LATERAL PIPING shall be installed in a minimum 4" wide by minimum 12"
deep trench.
CONNECTIONS to the required water supplies shall be copper in straight
lengths. Copper tube fittings shall be used in the globe antisyphon
valves and shall be cast brass or wrought copper and sweat- soldered.
RISER PIPING in confined bed areas to the sprinkler shrub heads shall
be copper.
RISER PIPING for lawn areas shall be threaded galvanized steel pipe and fittings
fabricated with a two directional swing joint per outlet.

PIPING -shall be sized according to the plan and plan notes.
ADJUSTMENT:
After installation has been completed, adjustment shall be made to the +r�
sprinkler system preparatory to final inspection.
The system shall be completely flushed to remove any and all debris from
the lines by removing the nozzle from all heads on ends of lines and
turning on the system..
All sprinklers shall be checked for proper operation and proper align- '
ment for direction of throw and coverage.
All pop -up spray nozzling shall be checked for proper arc of spray.
Prevailing wind conditions may necessitate adjustment. In this case,'
nozzles shall be changed to provide correct coverage at the Contractor's
expense. ;

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall.be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and page this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
