P. ,BONER AND ASSOCIATES, SAID SERVICES TO BE PROVIDED THROUGH THE CITY'S ARCHITECTURAL CONSULTANTS FOR THE PROJECT, CAUDILL ROWLETT SCOTT /SWANSON, HEISTER, WILSON AND CLAYCOMB, INC.; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That there is hereby appropriated out of the No. 208 • Auditorium Bond Fund $6,000 applicable to Project No. 208 -72 -2, Municipal Auditorium, for acoustics consultant services with C. P. Boner and Associates, said services to be provided through the City's architectural consultants for the project, Caudill Rowlett Scott /Swanson, Heister, Wilson and Claycomb, Inc. SECTION 2. The necessity to appropriate the aforesaid sums at the earliest practicable date in order that the project may continue without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shill be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested that said Charter rule be suspended, and that this ordinance be passed finally on the date of is introduction, IT IS ACCORDINGLY SO ORDAINED, this the day of 1974. Consultant perform certain acoustical consulting and design services in the interest of optimum acoustical performance for the Community Cultural Center, Corpus Christi, Texas, hereinafter called the Project. I. CONSULTANT'S SERVICES Consultant shall provide sufficient information to the Architects to enable them to provide.optimum acoustics and sound in the Project within- the scope of the Project and within the scope of Consultant's services. The services to be provided shall conform to the outline presented in Consultant's proposal of March 16, 1974, in addition to the agreement presented in said proposal with respect to conferences in Houston and Corpus Christi. II. FEES AND REI1BUPXEI -MNTS The Architects agree to pay to Consultant for his services, on a maximum fee basis, as follows: A. A maximum of $16$0.00 for the services included and performed during the Schematic Design phase of the Project, due upon completion of Schematic Design by the Architects; B. A maximum of $4350.00 for the services included and performed during Design Development /Construction Document phase, due following receipt of bids by the Owner for construction; C. Consultant sprees to absorb hie out -of- pocket travel expenses, telephone expenses, blueprinting/copying expenses incurred during the performance of his work; provided, however, that travel expenses covered in this section are limited in scope to the quantity of travel described in the aforementioned proposal of March 16, 1974; D. In the event that any re- design work is required of the Architect following the opening of bids, which requires subsequent consulting services by Consultant, Consultant agrees to perform such services gratis, unless the Owner contracts with the Architect separately for such redesign work. PERSONS BOUND The Architects and Consultant each binds themselves, their partners, successors, assigns and legal representatives to the other party to this Agreement. Neither Architects nor Consultant shall assign, sublet, or transfer his interest in this Agreement without the written consent of the other. The Architects and Consultant understand and agree to the full performance of this Agreement, as witnessed by their signatures below.
