HomeMy WebLinkAbout12155 ORD - 07/03/1974JRR:MLM:jkh:7 -2 -74; 1st TEXAS I AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH THE TEXAS A & I UNIVERSITY SYSTEM PERTAINING TO THE CONSTRUCTION OF ACCESS ROADS TO THE TEXAS A & I UNIVERSITY AT CORPUS CHRISTI, AS MORE FULLY SET FORTH IN THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; APPROPRIATING OUT OF THE NO. 207 PUBLIC BUILDING BOND FUND $19,161.06, REPRESENTING THE CITY'S SHARE OF CONSTRUCTION COSTS APPLICABLE TO PROJECT NO. 207- 72 -1.1; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That-the City Manager be and he is hereby authorized • to execute a contract with Texas A & I University System pertaining to the construction of access roads to the Texas A & I University at Corpus Christi, all as more fully set forth in the contract, a copy of which is.attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. There is hereby appropriated out of the No. 207 Public Building Bond Fund $19,161.06, representing the City's share of construction costs of the aforesaid access roads, applicable to Project No. 207- 72 -1.1. SECTION 3. The necessity to authorize the aforesaid contract and to appropriate the necessary sums in order that the access roads may be constructed without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emer- gency and necessity exist, and having requested that such Charter rule be suspended and that this ordinance be passed finally on the date of its,intro- duction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this thday of July, 1974. City retary APPSED: DAY OF JULY, 1974: EXEC._ ASST., City Att6rney MAYOR THE CITY OF CORPUS CHRISTI, TEXAS 12155 JRR:NI4:vp:7 /2 /74ast • CONTRACT THE STATE OF TEXAS 6 COUNTY OF NUECES This contract, by and between the City of Corpus Christi, Texas, a municipal corporation, hereinafter referred to as "CITY ", and the Texas A & I University System, a university duly established and operating under the statutes of the State of Texas, hereinafter called "A & I ", W I T N E S S E T H: WHEREAS, the City has funds available in the amount of Nineteen Thousand One Hundred Sixty -One and 06/100 Dollars ($19,161.06) available from the temporary investment of the One Million Five Hundred Thousand Dollars ($1,500,000) voted in the 1972 bond election for acquisition of facilities of the University of Corpus Christi; and WHEREAS, A & I desires to improve existing access roads to the campus; and WHEREAS, such improvements would be beneficial to the general flow of traffic on Ocean Drive, thereby easing traffic congestion in the immediate area; and WHEREAS, A & I has granted certain easements to City in connection with the construction of said access roads; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, That the City and A & I do enter the following agreement: 1. City hereby agrees to pay A & I the sum of Nineteen Thousand One Hundred Sixty -One and 06/100 ($19,161.06) as its total share for the construction of various access roads to the A & I campus. It is mutually understood between the parties that this sum represents the total amount due from the City. 2. A & I agrees that it will be in charge of the construction project, will take bids, let the contract, etc., and be responsible for all details of the construction work. 3. A & I agrees to indemnify and hold harmless City from any liability and /or claims arising out of the execution of this contract. FIN 2 -55 Revised 7/31/69 Corpus Christi, Texas JALday of 011& '19 /7 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
