HomeMy WebLinkAbout12163 ORD - 07/10/1974JRR:M1M:jkh:hb:6 /26/74:lst AN ORDINANCE AMENDING SUBSECTION 4.3 OF THE LAND DRILLING ORDINANCE, NO. 8879, SO AS TO REDUCE THE MINI- MUM DISTANCE REQUIRED BETWEEN A WELL AND A RESIDENCE FROM 400 FEET TO 200 FEET ONLY FOR THE REENTRY OF A WELL WHICH HAS BEEN PREVIOUSLY PLUGGED AND ABANDONED; PROVIDING FOR PUBLICATION; PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Land Drilling Ordinance, No. 8879, as amended, be amended by amending Subsection 4.3 thereof by changing the period to a semicolon and adding the following: "provided, however, that an existing well which has been previously plugged and abandoned may be reentered at any location which is more than 200 feet from any residence or other permanent structure intended for human occupancy where a permit has been obtained in accordance with Subsection 5.1 herein, as amended." SECTION 2. Publication shall be made one time in the official publication of the City of Corpus Christi, after final passage, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 3. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. 12163 That the foregoing ordinance was read for the first time_e�gd passed to its second reading on this the day of 19 /zk . by the following vote: Jason Luby • James T.
