HomeMy WebLinkAbout12170 ORD - 07/10/1974JRR:vp:7 /10/74:1st • AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT WITH SAM PERRINS FOR THE SALE BY THE CITY OF A PORTION OF LOT 6, SECTION B, PAISLEY'S SUBDIVISION OF THE HOFFMAN TRACT, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, ALL AS MORE FULLY SET FORTH IN THE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A "; AND DECLARING AN EMER- GENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to enter into a contract with Sam Perkins for the sale by the City of the City's interest in a portion of Lot 6, Section B, Paisley's Subdivision of the Hoffman Tract, situated in the City of Corpus Christi, Nueces County, Texas, all as more fully set forth in the contract, a copy of which is attached hereto, marked Exhibit "A ", and made a part hereof. SECTION 2. The necessity to authorize the City Manager to enter into the aforesaid contract in order to facilitate the sale of the parcel or tract of land described creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ��day of July, 1974. ATTEST: *Sr. . *Sr. ity Secretary MAY APPROVED: THE CITY OF CORPUS CHRISTI, TEXAS DAY OF JULY, 1974: /y 5�1 City Attorney 121'7® 7/10/74 7 /lo /7u CONTRACT THE STATE OF TEXAS COUNTY OF NUECES • This contract, by and between Mr. Sam Perkins, hereinafter referred to as "BUYER ", and the City of Corpus Christi, Texas, a municipal corporation, hereinafter referred to as "CITY", W I T N E S S E T H: WHEREAS , the City is the owner of certain surplus property as here- inafter described; and WHEREAS, the City has taken bids for the sale of said surplus property in accordance with appropriate statutory and Charter provisions; and WHEREAS, Buyer desires to purchase said surplus property; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that City and Buyer do enter into the following agreement: I The City hereby agrees to convey the following described property to Buyer in accordance with the terms and provisions hereinafter set out: Being a tract of land 25 feet in width and 210 feet in length out of the North one -half of the East one - quarter of Lot 6, Section B, Paisley's Subdivision of the Ro£fmaa Tract. II Buyer agrees to pay the City, as consideration for the above described premises, the sum of Nine Hundred ($900) Dollars. III Buyer agrees that the Warranty Deed to be delivered by the City upon receipt of the purchase price shall contain retention of an easement of pedestrian access through the entire property. ry Buyer further agrees that the Warranty Deed to be delivered by the City upon receipt of the purchase price will contain a restric- tion that the conveyance will be effective only so long as a portion of the abutting property is first used for public housing purposes in which the Housing Authority of the City of Corpus Christi has participated, and that upon failure of said use the conveyance shall become void and the title to said property shall revert to the City of Corpus Christi, its successors and assigns, who shall have the right to reenter and repossess itself of same. Upon failure of said use, Buyer shell be re- turned the Nine Hundred Dollars ($900) consideration expended for the subject property. V It is further agreed that the Warranty Deed to be delivered by the City will grant Buyer an option to relocate the pedestrian access easement retained on any abutting property that Buyer may own. It is further agreed that this option will exist for a period of five (5) years from the date of the passage of the ordinance closing Kay Street and that if said pedestrian access is not so relocated then the existing pedestrian access on the subject property shall become perpetual. Any relocation of said pedestrian access shall encompass a tract of at least twenty -five (25) feet in width. VI It is further agreed that in the event said pedestrian access is relocated, or in the event pedestrian or vehicular access is dedicated or opened by the abutting property owners, all access to the abutting parcels must be approved by the City Council, either by platting or other appropriate covenants. VII Buyer agrees to indemnify and hold harmless the City from any lia- bility and /or claims arising out of the execution of this contract. Mervin Townsend, City Manager ATTEST: City Secretary APPROVED: City Attorney Sam Perkins Corpus Christi, Texas lD day of , 19 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
