HomeMy WebLinkAbout12186 ORD - 07/17/19740 JRR:MLM:jkh:vmr:7= 12 -74; 1st AN ORDINANCE AMENDING ORDINANCE NO. 12123, PASSED AND APPROVED BY THE CITY COUNCIL ON JUNE 19, 1974, AS AMENDED BY ORDINANCE NO. 12165, DATED JULY 10, 1974, BY AMENDING SECTION 3 OF SAID ORDINANCE NO. 12123, SO AS TO PROVIDE THAT THE PUBLIC HEARING PROVIDED IN SAID ORDINANCE, RELATIVE TO IMPROVEMENTS YNGWN AND DESIGNATED AS UNIT VII OF THE SIDEWALK IMPROVEMENT PROGRAM, BE HELD AUGUST 14, 1974, IN THE COUNCIL CHAMBER AT CITY HALL AT 3:00 P.M., IN LIEU OF JULY 243 1974; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12123, passed and approved by the City Council on June 19, 1974, as amended by Ordinance No. 12165, dated July 10, 19742 be further amended by amending Section 3 of said Ordinance No. 12123, so as to provide that the public hearing provided in said ordinance, relative to improvements known and designated as Unit VII of the Sidewalk Improvement Program, as corrected and amended by Ordinance No. 12165, be held August 14, 1974, in the Council Chamber at City Hall at 3:00 P.M., in lieu of July 24, 1974, as presently provided in said Ordinance No. 12123. SECTION.2. That all ordinances or parts of ordinances in con- flict herewith be and they are hereby expressly repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction • it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made one time by publishing in the official newspaper of the City of Corpus Christi the caption of this ordinance stating in substance the purpose of the aforesaid ordinance. SECTION 5. The necessity to make the change as hereinabove provided in order to comply with the requirements of Article 1105b of the 12IL86 • • State Statutes relative to publication of public notice concerning street improvements creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAIMD, this the day of July, 1974.
