HomeMy WebLinkAbout12187 ORD - 07/24/1974• JRR:vmr:7-23-74; 1st • AN ORDINANCE CLOSING AND ABANDONING A 15 -FOOT UTILITY EASEMENT SITUATED IN LOT 9, OSO FARM TRACTS, SITUATED IN CORPUS CHRISTI, NUECES COUNTY, TEXAS, AS SHOWN BY PLAT RECORDED IN BOOR A. PAGE 49 OF THE MAP RECORDS OF NUECES COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 15 -foot wide utility easement in Lot 9, Oso Farm Tracts, in the City of Corpus Christi, Nueces County, Texas, as shown by plat recorded in Book A. Page 49 of the Map Records of Nueces County, Texas, the centerline of said easement being a portion of the southeast boundary line of Lot 1, Section 2, Tract A, Country Club Estates as shown by plat recorded in Volume 34, Page 50 of said Map Records, being more particularly described hereinafter; and WHEREAS, it has been determined that it is feasible and advan- tageous to the City of Corpus Christi to abandon said easement to the abutting property owners as it is not needed by the City, nor will it with- in the foreseeable future be needed by the City for any purpose whatsoever: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1, That the 15 -foot utility easement situated in Lot 9, Oso Farm Tracts, situated in the City of Corpus Christi, Nueces County, Texas, and as shown by plat recorded in Book A, Page 49 of the Map Records of Nueces County, Texas, the centerline of said easement being a portion of the southeast boundary line of Lot 1, Section 2, Tract A, Country Club Estates, as shown by plat recorded in Volume 34, Page 50 of said Map Records, being more particularly described as follows: BEGINNING at the most southerly corner of said Lot 1, Section 2, Tract A, Country Club Estates for a point in the southerly boundary line of this tract and the POINT OF BE- GINNING: THENCE S 61 °29130" E along the northeast right -of -way line of Saratoga Boulevard 7.50' to the southeast corner of this tract; THENCE parallel with and 7.50' southeasterly of the southeast boundary line of said Lot I N 28 °30'30" E 174.561; N 35 °18' E 323.49' to the intersection of the projection of southwest boundary line of an existing 10 wide easement for utilities for the northeast corner of this tract; 821-8 7 THENCE N 46 °56'05" W along said line of projection 15.14' to the northwest corner of this tract; THENCE parallel with and 7.50' northwesterly of said southeast boundary line of Lot 1 S 35 °18' W 326.41'; S 28° 30'30" W 175.44' to the northeast right -of -way line of Saratoga Boulevard for the southwest corner of this tract; THENCE S 61 °29'30" E along said right -of -way line 7.50' to the POINT OF BEGINNING. be and the same is hereby closed for public use and every municipal purpose and abandoned to the owners of the abutting property, in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas, SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of July, 1974.
