AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT
WITH H -S GREEN COMPANY, INC. FOR CONSTRUCTION OF
STREET IMPROVEMENTS FOR THE WESTPORT AREA AND
EVERHART ROAD; APPROPRIATING OUT OF NO. 220 STREET
BOND FUND $280,000, OF WHICH $263,104.34 IS FOR THE
CONSTRUCTION CONTRACT AND $16,895.66 IS FOR CONTINGENCIES
AND INCIDENTAL EXPENSES, APPLICABLE TO PROJECT NO.
220 -67- 92.10; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be, and he is hereby, authorized
to execute a contract with H -S Green Company, Inc., for construction of
street improvements for the Westport Area and Everhart Road, all as is
more fully described in the plans and specifications and contract documents
on file in the office of the City Secretary, all of which are made a part
hereof by reference and according to the bid of H -S Green Company, Inc.,
opened on June 5, 1974, said bid being the most advantageous to the City
of Corpus Christi.
SECTION 2. That there is hereby appropriated out of No. 220
Street Bond Fund $280,000, of which $263,104.34 is for the construction
contract and $16,895.66 is for contingencies and incidental expenses,
applicable to Project No. 220 =67- 92.10.
SECTION 3. That the necessity to authorize the execution of the
aforesaid contract and to appropriate the sums hereinabove set out at
the earliest practicable date so that construction may be commenced without
delay creates a public emergency and an imperative public necessity requir-
ing the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such
ordinance or resolution shall be read at three several meetings of the City
Council, and the Mayor having declared such emergency and necessity to
exist, and having requested the suspension of the Charter rule and that

this ordinance take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED, this the- of
July, 1974.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
