HomeMy WebLinkAbout12208 ORD - 08/07/1974MOTION moved and ✓LLGC/C ✓�/ or seconded the motion to amend the ordinance amending Ordinance No. 11613, increasing the water rates to provide an overall increase for customers using treated water, read on the first two of three readings on July 24, 1974 and July 31, 1974, prior to its third reading, said amended water rates to hereafter read as follows: SECTION 1. JRR:vp:0 -7 -74; Std 0 AN ORDINANCE MAKING FINDINGS OF FACT; AMENDING ORDINANCE NO. 11613, PASSED AND APPROVED AUGUST 8, 1973, BY AMENDING CERTAIN SCHEDULES THEREIN SO AS TO INCREASE THE WATER RATES TO PROVIDE AN OVERALL INCREASE FOR CUSTOMERS USING TREATED WATER, INCLUDING MINIMUM CHARGES; AMENDING ORDINANCE NO. 9472, PASSED AND APPROVED AUGUST 27, 19699 BY AMENDING CERTAIN SCHEDULES THEREIN SO AS TO INCREASE WATER RATES TO PROVIDE FOR AN INCREASE FOR FIRE PROTECTION SERVICE, AS MORE FULLY SET FORTH HEREINAFTER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE; PROVIDING AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. WHEREAS, some of the existing water rates of the City of Corpus Christi have remained unchanged since 1939, and most rates, with slight modifications, the last being in 1969, have been in effect since 1941; and WHEREAS, various costs of acquiring water, transporting of water, treatment and distribution of the same has been greatly increased since 1941 and 1969; and WHEREAS, existing conditions have been studied by the City Council and the City Council has concluded that a new schedule of rates should be adopted; and WHEREAS, costs in materials and operating costs, as well as antici- pated maintenance costs have increased at least 30 %; and WHEREAS, a rate increase is necessary to make the water distribution system more self - supportive and to avoid a tax increase: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict herewith. SECTION h. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose.
