AN ORDINANCE MAKING FINDINGS OF FACT: AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 11755, PASSED AND APPROVED OCTOBER 24, 1973, SO AS TO CHANGE THE SCHEDULE OF GAS RATES FOR ALL CUSTOMERS OR CONSUMERS OF THE CITY -OWNED GAS DIS- TRIBUTION SYSTEM BY AMENDING SECTION 38 -46 SO AS TO PROVIDE A NEW SCHEDULE OF RATES FOR ALL CUSTOMERS; PROVIDING AN EFFECTIVE DATE; PROVIDING A SEVERANCE CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the cost of providing natural gas supply for the con- sumers of Corpus Christi, Texas has increased at least twenty -two per cent (22 %) because of increased prices charged by suppliers; and WHEREAS, shortages of natural gas have further added to increased costs in natural gas distribution; and WHEREAS the City Council finds that an increase in gas rates is necessary to make such service more self - supportive and thereby avoid a tax increase, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 38 -46 of the Corpus Christi City Code, 1958, as amended, and particularly as amended by Ordinance No, 11755, passed and approved October 24, 1973, be and the same is hereby amended so as to provide a new schedule of rates for all customers, as follows: "RESIDENTIAL CUSTOMER RATE PRICE PER MCF Cycle 11 Cycle 10 Inside Outside In Nov. thru In April City Limits City Limits First 1 MCF Per Month $ 2.85 $ 3.85 Next 2 MCF " " 1.16 1.16 Next 7 MCF " " 1.10 1.10 Next 40 MCF " .99 .99 All over 50 MCF Per Month .72 .72 Min. Monthly Bill 2.85 3.85 1221.0 SEASONAL CUSTOMERS All customers who have requested a cutoff and a reconnection at the same location or for services to the same premises, including increases or reductions of the same premises, and which cutoff was not necessitated by reason of reconstruction of the building on the premises, shall be classified as seasonal customers, and in lieu of the rates applicable to all customers, there shall be charged and collected the following charges for gas furnished and delivered to the meters by the Department of Public Utilities of the City: SEASONAAL RATE PRICE PER MCF Outside Inside Inside Outside (Part Year Customers) City Limits City Limits First 1 MCF Per Month $ 3.60 $ 4.60 Next 2 MCF " " 2.56 2.56 Next 7 MCF " " 1.34 1.34 Next 30 MCF " " .99 ,99 All over 40 MCF .72 .72 Min. The rates established by this ordinance shall become effective with Cycle 1 of the September, 1974 billing. SECTION 3. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinances shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance.
