AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER, FOR AND
ON BEHALF OF THE CITY OF CORPUS CHRISTI, TO EXECUTE
A LEASE AGREEMENT WITH NUECES TRUST COMPANY,FOR THE
LEASING OF A PORTION OF A BUILDING AT 311 SOUTH
SHORELINE STREET, IN THE CITY OF CORPUS CHRISTI, TEXAS,
FOR A TERM OF ONE (1) YEAR, AT A RATE OF $160.00 PER
MONTH, FOR USE AS OFFICE SPACE BY THE CITY OF CORPUS
CHRISTI, A COPY OF WHICH LEASE AGREEMENT IS ATTACHED
HERETO AND MADE A PART HEREOF; AND DECLARING AN EMER-
GENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Manager be, and he is hereby, authorized
and directed, for and on behalf of the City of Corpus Christi, to execute a
Lease Agreement with Nueces Trust Company for the leasing of a portion of a
building located at 311 South Shoreline, in the City of Corpus Christi, Texas,
for a term of one (1) year, at a rate of $160.00 per month, for use as office
space by the City of Corpus Christi, a copy of which Lease Agreement is
attached hereto and made a part hereof, and is marked Exhibit "A ".
Section 2. The necessity to immediately execute the aforesaid
Lease Agreement so that the terms and conditions set forth therein can be
effected without delay creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction and that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared such emergency and necessity to
exist, having requested the suspension of said Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be.in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the 7 zic- day of 1974.

LEASE AGREEMENT

This Agreement of Lease made and entered into this the
day of August, 1974, by and between Nueces Trust Company, a Texas corporation,
hereinafter referred to as "Lessor ", and the City of Corpus Christi, a
municipal corporation and body politic, operating under the home rule
statutes of the State of Texas, acting herein by and through its duly
authorized City Manager, R. Marvin Townsend, hereinafter referred to as
"Lessee ":
W I T N E S S E T H
In consideration of the mutual covenants herein contained on
the part of Lessor and Lessee to be kept and performed, Lessor does hereby
lease unto Lessee a portion of a building and premises located at 311 South
Shoreline Street, in the City of Corpus Christi, more particularly described
as follows:
A portion of the building situated upon Lot Seven
(7) of the Subdivision of the Harney Tract of the
City of Corpus Christi, known as the Nueces Trust
Company Building and located at 311 South Shore-
line Street, and consisting of four (4) offices in
said building comprising approximately 514 square
feet in floor area.
Said properties are leased upon the terms, conditions and covenants as
follows:
1. The term of the lease is one (1) year beginning September 1,
1974, for a total rental of One Thousand Nine Hundred Twenty and No /100
Dollars.($1,920), payable each month at the rate of One Hundred Sixty and
No 1100 Dollars ($160) per month, the first payment to be made on or before
September 1, 1974, and a like payment to be due and payable on the let
day of each month thereafter for the full term of twelve (12) months, each
payment being in advance for the ensuing month.
2. Lessor shall provide, at its expense, normal maintenance
services sufficient to keep the premises described herein in a proper and

reasonable state of repair for the term of this lease.
3. In further consideration for the monthly rental payment to
the Lessor by the Lessee, the Lessor agrees to pay the cost of utility
services furnished to the herein described premises, such utility services
to expressly include lighting and air - conditioning. The Lessee will provide
janitorial service at no cost to Lessor, including carpet cleaning.
4. Lessee shall, at the end or other termination of this
lease, deliver up the demised premises in good order and condition, natural
deterioration and damage by fire and the elements excepted.
5. Lessor and Lessee are each hereby given the option of can-
celling this lease upon the giving of 30 days notice in writing by such party
desiring to cancel said lease.
IN TESTIMONY TWEREOF, the parties to this Agreement have here-
unto set their hands to duplicate originals, the day and year first above
written, after having first noted and approved all erasures, interlineations,
and insertions.

For the reasons set forth in the emergency clause of the foregoing
ordinance, a public emergency and imperative necessity exist for the suspen-
sion of the Charter rule or requirement that no ordinance or resolution shall
be passed finally on the date it is introduced, and that such ordinance or
resolution shall be read at three meetings of the City Council; I, therefore,
request that you suspend said Charter rule or requirement and pass this ordi-
nance finally on the date it is introduced, or at the present meeting of the
City Council.
