HomeMy WebLinkAbout12215 ORD - 08/07/1974JRR:jkh:hb:8 /7/74:lst • �J AN ORDINANCE AMENDING THE CITY BUDGET; AMENDING ORDINANCE NO. 12006, PASSED AND APPROVED BY THE CITY COUNCIL ON APRIL 17, 1974, BY AMENDING SECTION 3 OF SAID ORDINANCE SO AS TO CORRECT AND ADJUST THE ASSESS- MENTS LEVIED AGAINST ABUTTING PROPERTY OWNERS ON THE FOLLOWING STREET: NUECES BAY BOULEVARD, FROM INTERSTATE 37 TO LEOPARD STREET, AS HEREINAFTER PROVIDED; KEEPING IN EFFECT ALL OTHER PROVISIONS OF SAID ORDINANCE NO. 12006; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 12006, passed and approved by the City Council on April 17, 1974, be and the same is hereby amended by amending Section 3 so as to correct and adjust the assessments levied against abutting property owners on the following street: Nueces Bay Boulevard, from Interstate 37 to Leopard Street, as is reflected on the corrected and adjusted assessment roll, attached hereto and made a part hereof. SECTION 2. That except as herein provided, the terms and conditions of Ordinance No. 12006 shall be and remain in full force and effect. SECTION 3. Amendment of the City Budget to accomplish the purposes of this ordinance is necessitated for emergency expenditure in grave public necessity to meet unusual and unforseen conditions, which could not, by reasonable diligent thought and attention of the Government of the City of Corpus Christi, have been included in the current, original Budget of the City. SECTION 4. If for any reason any section, paragraph, sub- division, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite 12215 • intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 5. The necessity to make the adjustments and correc- tions outlined hereinabove in connection with the paving assessment project creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /day of , 1974. ATTEST: APPROVED: DAY OF AUGUST, 1974: Ir mac/ , City Attorne 0 MAYOR THE CITY OF CORPUS CHRISTI, TEXAS 0 AUGUST 2, 1974 FINAL CORRECTED ASSESSMENT ROLL Nueces Bay Boulevard, from Interstate 37 frontage road to the north R.O.W. line of Leopard Street. The construction of the street will consist of the excavation to a width and depth to permit the construction of standard curb and gutter section, a compacted 6" lime stabilized subgrade, an 8" lime stabilized caliche base to a width of 45' back to back of curb transitioning into a width of 55' back to back of curb at the intersection of I.H. 37 and Leopard Street to permit a right turn lane. Also to be constructed are concrete sidewalks varying in width from 4' to 6' tied i to back of curb 4" thick and 6" thick reinforced concrete driveways where shown on the plans or requested by the owners. The assessment rates have been determined in accordance with the City policy and by using the low bid submitted by Asphalt Paving and Construction Company, and applying the rate to the front footage of the abutting property. The assessment rates as applied are as follows; 45' wide street, curb, gutter and pavement $12.84 P.L.F. Sidewalk 0.81 P.S.F. Driveway 1.49 P.S.F. Credit has been given for all sidewalk, driveway and curb and gutter in place and meeting City standards. Maximum assessment rate for property committed to one and two family residential use or church or school as established by City Ordinance for curb, gutter and pavement is $4.75 P.L.F. or less according to bid price.
