HomeMy WebLinkAbout12224 ORD - 08/14/1974JRR:0c:8/13/74 • •1st AN ORDINANCE AMENDING ORDINANCE NO. 11954, PASSED AND APPROVED BY THE CITY COUNCIL ON MARCH 20, 1974, SO AS TO DELETE THAT PORTION OF HORNE ROAD IMPROVEMENTS UNIT II FROM AYERS STREET TO NAPLES STREET, REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, PROVIDING A SEVERABILITY CLAUSE, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 11954 passed and approved by the City Council on March 20, 1974, be and the same hereby is amended so as to delete therefrom the necessity for and the ordering of improvements in that portion of the Horne Road Improvements Unit II from Ayers Street to Naples Street. SECTION 2. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. The necessity to delete that portion of the Horne Road Improvements Unit II from Ayers Street to Naples Street creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance take effect 1222k and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �day of August, 1974.
