CLARKWOOD ROAD, FROM IRIS STREET TO LOT 9, BLOCK 10, CLARKWOOD TOWNSITE, EAST SIDE; 2. EVERHART ROAD, FROM SOUTH P/L OF LOT 1, BLOCK 2, ALAMEDA ESTATES #2 TO THE NORTH P/L OF LOT 16, BLOCK 3, ALAMEDA ESTATES # 3, SOUTHEAST SIDE; PROVIDING FOR RELEASE OF LIEN ON SAID DELETED ITEMS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 'I SECTION .l. THAT ORDINANCE NO. 12123, PASSED AND APPROVED JUNE 19, 1974, AS AMENDED BY ORDINANCE NO. 12165, PASSED AND APPROVED JULY 10, 1974, BE FURTHER AMENDED SO AS TO DELETE FROM SIDEWALK IMPROVEMENTS, UNIT VII, THE FOLLOWING STREETS: 1. CLARKWOOD ROAD, FROM IRIS STREET TO LOT 9, BLOCK 10, CLARKWOOD TOWNSITE, EAST SIDE; 2. EVERHART ROAD, FROM SOUTH P/L OF LOT 1, BLOCK 2, ALAMEDA ESTATES #2, TO THE NORTH P/L OF LOT 16, BLOCK 3, ALAMEDA ESTATES #3, SOUTHEAST SIDE. SECTION 2. THAT THE FILING, IN THE OFFICE OF THE COUNTY CLERK OF NUECES COUNTY, OF A RELEASE OF LIEN SO AS TO EFFECT THE RELEASE OF THE HEREINABOVE DELETED ITEMS, AND TO RELEASE THOSE ITEMS WHICH WERE PREVIOUSLY DELETED FROM THE ORIGINAL PROJECT AS SET FORTH IN ORDINANCE 12165, PASSED AND APPROVED BY THE CITY COUNCIL ON JULY 10, 1974, IS HEREBY AUTHORIZED. SECTION 3. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH BE AND THE SAME ARE HEREBY REPEALED TO THE EXTENT OF SAID CONFLICT. SECTION 4. IF FOR ANY REASON ANY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE SHALL BE HELD INVALID OR UNCONSTITUTIONAL BY FINAL JUDGMENT OF A COURT OF COMPETENT JURISDICTION IT SHALL NOT AFFECT ANY OTHER SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD, OR PROVISION OF THIS ORDINANCE, FOR IT IS THE DEFINITE INTENT OF THIS 1`2.311 CITY COUNCIL THAT EVERY SECTION, PARAGRAPH, SUBDIVISION, CLAUSE, PHRASE, WORD OR PROVISION HEREOF BE GIVEN FULL FORCE AND EFFECT FOR ITS PURPOSE. SECTION 5. THE NECESSITY TO IMMEDIATELY MAKE THE HEREINABOVE SET FORTH AMENDMENTS AND TO AUTHORIZE THAT A RELEASE OF LIEN BE FILED ON THOSE PROPERTIES DELETED FROM THIS PROJECT HEREIN AND BY ORDINANCE No. 12165 AT THE EARLIEST POSSIBLE DATE CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE 9 /DAY OF , 197+. ASS TITY ATTORNEY n Corpus Christi, Texas • day of , 191 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
