AN ORDINANCE AMENDING THE CITY BUDGET; APPROPRIATING OUT OF NO. 220 STREET BOND FUND $36,000, OF WHICH $33,075.98 IS FOR THE CONSTRUCTION CONTRACT AND $2,924.02 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT N0. 220- 72 -11; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH E. J. NETEK CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF SIDEWALK IMPROVEMENTS, UNIT VII; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby appropriated out of No. 220 Street Bond Fund $36,000, of which $33,975.98 is for the construction contract and $2,924.02 is for contingencies and incidental expenses, all applicable to Project No. 220- 72 -11. SECTION 2. That the City Manager is hereby authorized to execute a contract with E. J. Netek Construction Company for the construction of Sidewalk Improvements, Unit VII (Project No. 220- 72 -11). SECTION 3. Amendment of the City Budget to accomplish the purposes of this ordinance is necessitated for emergency expenditure in grave public necessity to meet unusual and unforseen conditions, which could not, by reasonable diligent thought and attention of the Government of the City of Corpus Christi, have been included in the current, original Budget of the City. SECTION 4. The necessity to authorize the appropriation of the sum hereinabove set forth and to authorize the execution of the above described contract to that this project may proceed in an orderly manner creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency to exist, having requested the suspension of the Charter rule and that this ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY 12235 C: SO ORDAINED this the � aday of August, 1974.
