HomeMy WebLinkAbout12238 ORD - 08/28/1974JRR:JB:hb:8 /13/74: 1st AN ORDINANCE APPROVING A NEW RATE SCHEDULE FOR THE PURNISHING OF COMMUNITY ANTENNA TELEVISION SERVICES WITHIN THE CITY OF CORPUS CHRISTI BY ATHENA CABLEVISION OF CORPUS CHRISTI, INC.,UNDER ANY FRANCHISE RE- NEWAL; PROVIDING THAT THIS ORDINANCE SHALL NOT RESTRICT THE POWER OF THE CITY TO RE- DETERMINE RATES; PROVIDING SEVERABILITY; AND REPEALING ALL ORDINANCES IN CONFLICT THEREWITH. WHEREAS, Athena Cablevision of Corpus Christi, Inc., (hereinafter referred to as Athena) has requested that its franchise to operate a community antenna television system in the City of Corpus Christi be renewed for a term of five (5) years; and WHEREAS, Athena has also requested approval by the City Council of new rates for services to be rendered under any such renewal of its franchise; and WHEREAS, a public hearing on the request for increased rates was held by the City Council on August 14, 1974; and WHEREAS, at such hearing Council received and considered comments and data concerning Athena's investment in the system, Athena's general financial condition, the cost of rendering services, and other matters relevant to a determination of proper rates: NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. The City Council approves and Athena is hereby authorized to charge for its services the following rates, to become effective upon the effective date of the franchise renewal term, if granted: I. INSTALLATION CHARGES for applications for service on file with Franchisee.on or before the expiration date of the current franchise, granted by Ordinance No. 9470, and for installations in areas where service was not yet available as of the expiration date of the franchise granted by Ordinance No. 9470: A. Initial tap-in connection charge for one outlet - - - - - - - - - - - - no charge B. Thirty -day trial period - - - - - - - no charge I C. Each Additional outlet - - - $5.00 II. INSTALLATION CHARGES for all other installations, unless otherwise specified by the terms of the franchise: A. Initial tap -in and connection charge - - - - - - - - - - - 15.00 B. For each additional outlet - 5.00 III. MONTHLY RATES for the following types of service: A. All subscribers except as listed in B: 1. One outlet - - - - - - - 5.75 per month 2. Each additional outlet - .75 per month B. Public schools, colleges and nonprofit hospitals - - - - no charge IV. When a converter is necessary to receive all desired channels the following charges are permitted: A. A refundable deposit of $20.00 and a monthly service charge 1.00 OR B. Purchase of the converter 35.00 SECTION 2. This ordinance is not intended to restrict or waive the right of City to re- determine rates at any time and require the furnishing to the City of such information as the City may deem necessary for the purpose of considering any such re- determination of rates. Nor does this ordinance intend to restrict the right of Athena to request approval of rate changes during the term of the renewed franchise. SECTION 3. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent Jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict. f That the foregoing ordinance as rend for the first time and passed to its second reading on this the day of 19 by the following vote: Jason Luby James T.
