HomeMy WebLinkAbout12255 ORD - 09/04/19740 JRR:jkh:9 -4 -74; 1st • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 3, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JEWEL HOMES, INC., BY AMENDING ME ZONING MAP BY CHANGING THE ZONING ON TRACT "A" AND ON TRACT "B ", MORE PARTICULARLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF COPRUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -lB" ONE FAMILY DWELLING DISTRICT TO "B -1" NEIGHBORHOOD BUSINESS DISTRICT AS TO TRACT "A ", AND FROM "R -111" ONE FAMILY DWELLING DISTRICT TO "I -2" LIGHT INDUSTRIAL DISTRICT AS TO TRACT`$ "; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS' FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION OF Jewel Homes. Inc. _ FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON Wednesday, September 4, 1974 , AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE Z014ING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. 112255 SECTION 2. That the zoning of the following described parcels or tracts of land be and the same be changed from "R -1B" One Family Dwelling District: Tract "A ", changed to "B -1" Neighborhood Business District and Tract "B ", changed to "I -2" Light Industrial District, said Tracts being more particularly described as follows: TRACT "A" Being 1.02 acres of land situated in Lot 8, Section 4, Bohemian Colony Lands as shown by map recorded in Volume 4, page 48, Map Records of Nueces County, Texas, being more particularly described as follows: BEGINNING at the East corner of Lot 1, Elk. 7, Two Fountains Unit 1 as shown by Map recorded in Volume 36, Page 141, Map Records of Nueces County, Texas, same being a point on the Southwest bound- ary of Lot 22, Elk. 2, Two Fountains Unit 1 as shown by Map recorded in Volume 35, Page 41, Map Records of Nueces County, Texas for the North corner of this tract; THENCE South 61 °34115" East with the Southwest boundary of Lots 22, 23 and 24, Blk. 2 Two Fountains Unit 1, as shown by Map recorded in Volume 35, Page 41, of said Map Records and Lots 25, 26, 27, 28, 29, and 30, Blk. 2 Two Fountains Unit 2 as shown by Map recorded in Volume 35, Pages 134 and 135, Map Records of Nueces County, Texas, 442.98 feet to the North corner of Lot 3, Blk. 9 Two Fountains Unit 1, as shown by Map recorded in Volume 38, Page 15, Map Records of Nueces County, Texas for the East corner of this tract; THENCE South 28 °57115" West with the Northwest boundary of said Lot 3, Blk. 9, 100.00 feet for the South corner of this tract; THENCE North 61 034115" West 442.98 feet to a point on the Southeast boundary of said Lot 1, Blk 7 Two Fountains Unit 1 for the West corner of this tract; THENCE North 28 057115" East with said Southeast boundary of Lot 1, Blk. 7 Two Fountains Unit 1, 100.00 feet to the POINT OF BEGINNING and containing 1.02 acres. TRACT "B" Being 3.03 acres of land, situated in Lot 8, Section 4, Bohemian Colony Lands as shown by map recorded in Volume 4, page 48, Map Records of Nueces County, Texas, being more particularly described as follows: BEGINNING at the South corner of Lot 1, Blk. 7, Two Fountains Unit 1 as shown by Map recorded in Volume 36, Page 141, Map Records of Nueces County, Texas same being a point on the Northeast right - of -way of South Padre Island Drive, for the West corner of this tract; THENCE North 28 °57115" East with the Southeast boundary of said Lot 1, Blk. 7 298.12 feet for the North corner of this tract; THENCE South 61 °34'15" East 442.98 feet to a point on the Northwest boundary of Lot 3, Blk. 9, Two Fountains Unit 1 as shown by Map recorded in Volume 38, Page 15, Map Records of Nueces County, Texas for the East corner of this tract; THENCE South 28 °57'15" West with said Northwest boundary of Lot 3, Blk. 9, 298.12 feet to a point on said Northeast right -of -way of South Padre Island Drive for the West corner of said Lot 3, Block 9 and the South corner of this tract; THENCE North 61 °34'15" West with said Northeast right -of -way of South Padre Island Drive, 442.98 feet to the POINT OF BEGINNING and containing 3.03 acres. I• • SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION 11. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED ON THE 27TH DAY OF AUGUST, 1937, AS A14ENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT 'ALL-TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE_�DAY OF ATTEST: -�TARY MAYOR APPR VED: THE CITY OF CORPUS CHRISTI, TEXAS DAY OF S� CITY AT TORNEY Corpus Christi, Texas day of 19 TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspen- sion of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordi- nance finally on the date it is introduced, or at the present meeting of the City Council.
