HomeMy WebLinkAbout12267 ORD - 09/18/1974r [ T ., • JRR:e:hb:8 /14/74: 1st AN ORDINANCE AMENDING SECTION 1 of ORDINANCE NO. 9635, AS AMENDED BY ORDINANCE NO. 10445, SO AS TO ADOPT THE CHANGES ADOPTED BY THE TEXAS AIR CONTROL BOARD FOR THE CONTROL OF AIR POLLUTION WITHIN THE CITY OF CORPUS CHRISTI; PROVIDING A PENALTY; PROVIDING FOR PUBLICATION; DIRECTING THE CITY SECRETARY TO FORWARD A COPY OF THIS ORDINANCE TO THE TEXAS AIR CONTROL BOARD: AND PROVIDING A SEVERANCE CLAUSE. WHEREAS, the City of Corpus Christi, by Ordinance No. 9635, as amended by Ordinance No. 10445, adopted rules and regulations for the control of air pollution within the City of Corpus Christi, as said rules and regulations were adopted by Texas Air Control Board, pursuant to the Clean Air Act of Texas, 1967 (Article 4477 -5, V.T.C.S.); and WHEREAS recent revisions have been adopted by the Texas Air Control Board; and WHEREAS, it is imperative that the local rules and regulations for control of air pollution be in accord with the Federal and State Air Control Regulations, as amended from time to time: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 1 of Ordinance No. 9635, passed and approved by the City Council on the 4th day of February, 1970, as amended by Ordinance No. 10445, passed and approved by the City Council on September 1, 1971, be and the same is hereby amended to read as follows: "That the Rules and Regulations of the Texas Air Control Board are hereby adopted as rules and regulations for the control of air pollution in the City of Corpus Christi, Texas, as follows: 1. Texas Air Control Board General Rules, effective March 5, 1972, August 31, 1972, May 12, 1973 and December 1, 1973; 2. Texas Air Control Board Regulation I, effective March 5, 1972 and January 19, 1974; 3. Texas Air Control Board Regulation II, effective March 5, 1972, and January 19, 1974; -jaww /1,1-67 4. Texas Air Control Board Regulation III, effective June 8, 1974; 5. Texas Air Control Board Regulation IV, effective December 1, 1973; 6. Texas Air Control Board Regulation V, effective May 12, 1973; 7. Texas Air Control Board Regulation VI, effective August 31, 1972; 8. Texas Air Control Board Regulation VII, effective August 31, 1972; 9. Texas Air Control Board Regulation VIII, effective March 5, 1972; a copy of said regulations identified by the signature of the City Secretary being on file in the Office of the City Secretary and made a part of this ordinance the same as if written herein. The Clean Air Act of Texas, 1967 (Article 4477- V.T.C.S.) as it reads as of the date of passage of this ordinance is hereby adopted for the control of air pollution within the City of Corpus Christi." SECTION 2. That the violation of any of said rules and regulations is hereby declared to be unlawful and punishable by a fine in the Municipal Court, upon conviction, of a fine of not more than two Hundred Dollars ($200.00) for each offense thereof. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 4. The City Secretary is hereby directed to furnish a copy of this ordinance, without the necessity of having a copy of said regulations attached thereto, to the Executive Secretary, Texas Air Control Board, in Austin, Texas. SECTION 5. If for any reason any section, paragraph, sub- division, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, -2- clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, sub- division, clause, phrase, word or provision hereof be given full force and effect for its purpose.
