HomeMy WebLinkAbout12275 ORD - 09/18/19740 JRR:jkh:9- 17 -74; !at is AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE A DEED FOR THE SALE OF A PORTION OF LOTS 10 AND 11, BLOCK 4, EDGEWATER TERRACE, CONSISTING OF APPROXIMATELY 9800 SQUARE FEET, AS MORE FULLY DESCRIBED HEREINAFTER, TO LES FELDSER FOR THE CONSIDERATION OF $5100 AS A COMPROMISE SETTLEMENT OF CAUSE NO. 614, STYLED CITY OF CORPUS CHRISTI V. NORMAN RANSLEBEN, ET AL, BEING A PROCEEDING IN EMINENT DOMAIN FOR THE ACQUISITION OF RIGHT OF WAY FOR THE OCEAN DRIVE- ALAMEDA JUNCTION IMPROVEMENTS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized and directed to execute a Deed for the sale of a portion of Lots 10 and 11, Block 4, Edgewater Terrace, as more fully described hereinafter, to Les Feldser for the consideration of $5100 as a compromise settlement of Cause No. 614, styled City of Corpus Christi v. Norman Ransleben, et al, being a proceeding in eminent domain for the acquisition of right of way for the Ocean Drive - Alameda Junction Improvements, said portion of Lots 10 and 11, Block 4, Edgewater Terrace, being more particularly described as follows, to -wit: A portion of Lots 10 and 11, Edgewater Terrace, being an irregular shaped tract of land out a portion of Lots 10 and 11, Block 4, Edgewater Terrace, as shown by map of record in Volume 7, page 3, Nueces County, Texas Map Records, and more particularly described by metes and bounds as follows: Beginning at the most southerly corner of said Lot 10, Block 4, Edgewater Terrace for the most southerly and beginning corner of the tract of land herein described; Thence No. 28° 10' 30" E. a distance of 137.01 feet along the most westerly boundary line of said Lot 10 to a point; Thence S. 33° 22' 20" E. a distance of 51.02 feet to a point for the P.C. of a curve; Thence to the right along a circular curve whose central angle is 34° 01' 05" with a radius of 204.26 feet a distance of 121.32 feet to a point; Thence to the right along the arc of a circular curve whose central angle is 1° 28' 48" with a radius of 600.40 feet a distance of 15.51 feet to a point for the most southeasterly corner of Lot 11, Block 4, Edgewater Terrace; Thence along the most southerly boundary line of said Lots 11 and 10, a distance of 216.0 feet to the place of beginning. 122'75 SECTION 2. The necessity to immediately authorize the execution of the aforesaid deed creates a public emergency and an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the //!da of September, 1974.
