HomeMy WebLinkAbout12282 ORD - 09/25/1974�/Uo7-1 aA; J7q ,tan G.ko MOTION That the Ordinance amending the OCL Water Policy to eliminate the platting requirement for property outside the City limits which is in excess of five acres and which is devoted to uses connected to the Port of Corpus Christi, read on the first two of three readings on September 11, 1974 and September 18, 1974, be amended prior to the third and final reading as ' follows: 1. Add to the caption of the ordinance, before the severability clause, the penalty provision, reading: "PROVIDING FOR PENALTY ", and adding as Section 3 of the ordinance the following: "SECTION 3. Any person, firm or corporation violating the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction, shall be fined in a sum not to exceed Two Hundred Dollars ($200.00)." 2. Renumber the present Section 3 as Section 4 and the present Section 4 as Section 5. Motion carried. RWC:e:9 /25/74 :3rd • AN ORDINANCE AMENDING ORDINANCE NO. 4168, AS AMENDED, GENERALLY KNOWN AS THE PLATTING ORDINANCE, BY AMENDING SECTION I THEREOF BY DELETING THEREFROM THE LAST SENTENCE OF SAID SECTION I - GENERAL; BY ADDING A NEW SECTION DESIGNATED "SECTION I -A. EXCEPTIONS" SO AS TO PROVIDE EXCEPTIONS WITH RESPECT TO TRACTS OF LAND CONVEYED TO OR BY ANY GOVERNMENTAL ENTITY, TRACTS OF FIVE (5) ACRES OR MORE DEVOTED TO PORT OF CORPUS CHRISTI CARGO GENERATION OR DISTRIBUTION; PROVIDING FOR PUBLICATION; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 4168, as amended, generally known as the Platting Ordinance, be amended by amending Section I thereof by deleting the last sentence of said Section I - General so that said Section I will here- after read as follows: - "SECTION I - GENERAL Before any plan, plat, or replat of a lot, subdivision, or addition of land inside the City of Corpus Christi or within five (5) miles of the City limits thereof shall be recorded with the County Clerk of Nueces County, it shall first be approved by the Planning Commission of the City of Corpus Christi in conformity with Article 974x, V.A.C.S., and the provisions of this ordinance. No transfer of land in the nature of a lot, subdivision, or addition as defined herein shall be exempt from the provisions of this ordinance even though the instrument or document of transfer may describe land by metes and bounds. The filing of any plan, plat, or replat without complying with the requirements of this ordinance, or the transfer of land by the filing of any instrument in the nature of a conveyance without having first obtained an approved plat thereof in compliance with the requirements of this ordinance, shall be deemed a violation of the provisions of this ordinance and of the provisions of the City Charter. Wherever the terms "subdivision" or "subdivider" appear herein, it shall include "lot" and 'owner ", respectively, and the plat of a lot shall comply with all the provisions of this ordinance to the same extent as the plat of a subdivision. 12282 SECTION 2. That Ordinance No. 4168, as amended, be amended by adding a new section to be designated SECTION I -A. EXCEPTIONS, to read as follows: "SECTION I -A. EXCEPTIONS There shall be excepted from the requirements of this ordinance: (1) Any conveyance transferring any land or interest in land to or from any governmental entity. (2) Tracts of land consisting of five (5) acres or more, which are accumu- lations under one ownership, of existing platted or unplatted lots, blocks or tracts and are principally devoted to the direct production, manufacture, processing or distribution of cargo shipped or to be shipped through the Port of Corpus Christi:, SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section,paragraph, subdivision, clause, phrase, word or provision of this ordinance,for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
