HomeMy WebLinkAbout12290 ORD - 10/02/1974JRR:jkh:9- 25 -74; 1st • • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF nit ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31 -5 BY ADDING THERETO TWO NEW SUBSECTIONS, TO BE NUMBERED 31 -5.11 AND 31 -5.12, SETTING FORTH ZONING CLASSIFICATIONS ON TWO DESCRIBED TRACTS OF LAND WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACTS BEING OUT OF THE FORMER W. E. POPE ESTATE TRACT LOCATED ON THE NORTH END OF CORPUS CHRISTI BEACH LYING ADJACENT TO THE WEST BOUNDARY LINE OF HIGHWAY 181, MORE PARTICULARLY DESCRIBED HEREINAFTER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi, Texas; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on September 25, 1974 at Special Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That "R -1B" single family residential zoning which the land described herein acquires upon annexation is a temporary zoning classification. (2) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and,that permanent zoning of "A -T" Apartment Tourist District and "B -4" General Business District should be granted to the two tracts of land described herein. (3) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning. 12290 • (4) That the City Council finds in its opinion and inde- pendent judgment, as a matter of fact, that the existing zoning classi- fication of said land is temporary and that the facts and circumstances relating to the zoning of said land require that the permanent zoning of "A -T" Apartment Tourist and "B-4" General Business District be granted thereto. WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordi- nance of the City of Corpus christi, Section 31 -5, by adding thereto a new subsection to be numbered Section 31 -5.11 and by adding thereto a new subsection to be numbered Section 31 -5.12, said respective new subsections to hereafter read as follows: "Section 31 -5.11. The following described tract of land shall be zoned and classified as "AT" Apartment- Tourist District: Being a parcel of land containing approximately 7. 39 acres out of the former W. E. Pope Estate Tract located on the north end of Corpus Christi Beach lying adjacent to the west boundary line of Highway 181, more particularly described by metes and bounds as follows: BEGINNING at the intersection of the Northeast corner of Channel A and the Southwest corner of The Nueces County Navigation District #1 North bulkhead line of the Rincon Canal, traveling South 57° 52. 00' East a distance of 430. 00 feet; -2- • • THENCE South 32° 08' West a distance of 748. 33 feet for a corner of this parcel. THENCE North 57 °52' West a distance of 430.00 feet to the easterly bulkhead line of Canal A for a corner of this parcel; THENCE North 32°08' East along the easterly bulkhead line of CanalA a. total distance of 748. 33 feet to a point at the intersection of this line with the Nueces County Navigation District #1 North bulkhead line of the Rincon Canal, for a corner of this parcel. "Section 31 -5.12. The following described tract of land shall be zoned and classified as "B -4" General Business District: Being a parcel of land containing approximately 15.76 acres out of the former W. E. Pope Estate Tract located on the north end of Corpus Christi Beach lying adjacent to the west boundary line of Highway 181, more particularly described by metes and bounds as follows: BEGINNING 130 feet North 57° 52. 00' West of the iron pipe on the West right -of -way line of U. S. Highway #181 from which point the intersection of the North right -of -way line of Burleson Street and the West right -of -way line of U.S. Highway #181 right -of -way line intersect, marked by a three quarters inch iron pin near a flush -type concrete highway marker, bears South 32° 08' West a distance of 3460. 84 feet; THENCE North 57° 52' West a distance of 430. 00 feet to an iron pipe on the easterly bulkhead line of Canal A for a corner of this parcel; THENCE North 32° 08' East along the easterly bulkhead line of Canal A a distance of 1597. 16 feet to form the Northeast corner of this parcel; THENCE South 57° 52. 00' East a to tal distance of 430. 00 feet for a corner of this property; THENCE South 32° 08' West a distance of 1597. 16 feet for a corner of this parcel. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. The necessity for making the aforesaid changes immediately for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordi- nance or resolution shall be passed finally on the date of its introduction -3-- • • but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and neces- sity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �" (day of d , 1974.
