HomeMy WebLinkAbout12297 ORD - 10/09/1974�JRR:jkh:9- 25-74; Irt • AN ORDINANCE CLOSING PORTIONS OF SOUTH STAPLES STREET RIGHT OF WAY, MORE FOLLY DESCRIBED HEREINAFTER; AUTHORIZING THE CITY MANAGER TO EXECUTE QUITCLAIM DEEDS TO THE OWNERS OF PROPERTY ABUTTING SAID PORTIONS OF SOUTH STAPLES STREET HEREBY CLOSED; PROVIDING FOR SEVERABILITY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of portions of South Staples Street, as more fully described hereinafter, was given by publication and registered mail to the last 'known addresses of the owners of property abutting said street and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting on Wednesday, September 18, 1974, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the portionsof South Staples Street hereinafter more fully described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter described portions of South Staples Street, situated in the City of Corpus Christi, be and the same are hereby closed for public use and abandoned to the owners of the abutting property, as hereinafter set forth: A 20' wide by 50' long strip of South Staples Street Right -of -Way abutting Lot "C" out of that portion of Staples Street Right -of -Way dedicated by plat of Gardendale Gin Tract, Lot "C ", as recorded in Vol. 27, Pg.-35, Mep Records of Nueces County, Texas, to be abandoned and quitclaimed to Lawrence J. Berger; A. 10' wide by 58.28' long strip of South Staples Street Right -of -Way abutting Lot 8 -A out of that portion of Staples Street Right -of -Way dedicated by plat of Gardendale Subdivision, Block 6, Lot 8 -A, as recorded in Vol. 30, Pg. 58, Map Records of Nueces County, Texas, to be_abandpped.and quitclaimed to Blanche Starrett; 1229'7 A. 10' wide irregular strip of South Staples Street Right -of -Way abutting Lot 10 -A out of that portion ofSouth Staples Street Right -of -Way dedicated by plat of Lot 10 -A, Block 6, Gardendale Subdivision as recorded in Vol. 32, Pg. 25 of the Map Records of Piueces County, Texas and more fully described by metes and bounds as follows: Beginning at the most easterly corner of said Lot 10 -A; Thence S 610 00' 40" E. a distance of 10 feet to a point; Thence.•S 290 W. a distance of 60 feet to the P.C. of a circular curve to the right; Thence in a Southwesterly direction with the arc of a curve whose central angle is 890 59' 20; Radius = 101, Tangent = 10', a distance of 15.71 feet to the P.T. of the curve; Thence N. 610 00' k-0" W. a distance of 10 feet to the P.C. of a circular curve to the left; Thence in an Easterly direction with the are of the curve whose central angle, is 890 59' 20 ", Radius = 10', Tangent = 101, a distance of 15.71 feet to the P.T. of the curve; Thence N. 2-90 00' E. a distance of 60 feet to the point of beginning, to be abandoned and quitclaimed to Circle R Corporation; A 10' wide by 165' long strip of South Staples Street Right -o£ -Way abutting Tract "A ", "B" & "C ", out of that portion of South Staples Street Right -of -Way dedicated by plat of Tracts A, B, & C, Lot 1 -C, Lokey Subdivision, as recorded in Vol. 27, Pg. 61, Map Records of Nueces County, Texas, to be abandoned and quitclaimed to W. F. Westbrook, at ux; A: 10' wide by 58' long strip of South Staples Street Right -of -Way abutting the'Southwest 58' of Tract "A:, Lot 16 -C out of that portion of South Staples Street Right -of -Way dedicated by plat of Tract "A:, Lot 16-C, Lokey Subdivision, recorded in Vol. 27, Pg. 17, Map Records of Nueces County, Texas. to be abandoned and quitclaimed to Harry G. Plomarity subject to dedication by Harry G. Plomarity of the following described parcel or tract of land to the City of Corpus Christi: - Being a 2' wide by 35' long strip abutting South Staples Street right of way out of Northeast 35' of Tract "A ", Lot 16 -C, Lokey Subdivision as recorded in Vol. 27, p. 17, Map Records of Nueces County, Texas and containing 70 sq. ft. of land more or less. The existing building on this lot will be allowed to encroach on this new right of way until the building is removed or demolished. An. irregular shaped tract of lend out of South Staples Street Right -of -Way abutting Lot 1, Staples Grove, Unit No. 1 as recorded in Vol. 19, Pg. 92, Map Records of Nueces County, Texas and being more particularly described by metes and bounds as follows: Beginning at the common corner of Lots 8 and 9, Section 4 and Lots 1 and 16 Section 12, Flour Bluff and Encinal Farm and Garden Tracts being the intersection of the original center line of South Staples Street and a 75 foot wide drainage easement-, -2- Thence N. 610 W 50' and N. 291 E. along the Northwest Right -of -Way line of South Staples Street a distance of 95 feet to the P.C. of a circular curve to the left and beginning point of this description; Thence in a Northerly direction with the are of a circular curve to the left whose central angle is 900, Radius 30', Tangent 30', a distance of 47.12.feet to the P.T. of the curve; Thence S 611 E. a distance of 30 feet to a point in the Northwest Right -of- Way Line of South Staples Street; Thence S. 291 W. a distance of 30' to the place of beginning and containing 193.14 square feet more or less, to be abandoned and quitclaimed to Duaine A. Davis. SECTION 2. That the City Manager is hereby authorized, for and on behalf of the City of Corpus Christi, to execute Quitclaim Deeds to the owners of property abutting the portions of South Staples Street, as set forth herein- above SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
